I wasn't referring to a freedom of speach issue. I was referring to the use of the www.ebaysucks.com domain name. This would be a trademark issue.

I could be wrong but it seems that you are making use of their trademark name in an attempt to ruin their business and in doing so could be made to pay damages to ebay.

You could be right. I'm not a legal expert but I have watched, with interest, as Ty Warner took down one web site after another for using "Beanie" OR "TY" in their domain name. The use of "Ebay" in www.ebaysucks.com to me would be similar. I think.

There is a legal loophole that will allow you to parody a trademarked symbol, name, phrase, song (to a certain extent; "Weird Al" had to learned the hard way on one song), or any other protected image.

One more question. How is Ebay a monopoly?

You can't really compare the MSFT -vs- the government issue to Ebay. People can leave Ebay at any time and take their auctions to a competitor (say Yahoo). Ebay doesn't hold the buyers hostage either. What does Ebay do that is anti-competitive?

Fiesty: Are you serious? eBay is not a monopoly? Then why does 95% of internet auction sales take place on ebay. No I'm sorry this is a monopoly, there is no one close to ebay right now, if you doubt this than ask people why they do sell on ebay, its because there is no traffic at other sites, yahoo and amazon are the closest and they only get about 1% of the sales each as ebay recieves. Also, do people really have to buy from Bill Gates?

Crystal: Your so right, the reason people are stuck slaving for ebay and paying ridiculous fees for the same service available on other sites is they are scared to take a chance on taking a temporary loss on their sales and continue to support the tyrant, anyone here care to support ebay? I would love to hear your arguement(s)...

I'm confused.

Timeforebaytodie says he won't stop until he's reinstated by eBay. Presumably he wishes to be reinstated so that he can buy and/or sell on eBay. In another post he says eBay is a tyrant and he is against supporting a tyrant.

Doesn't buying and selling on eBay result in supporting eBay?

At least you could try to get that fact right. It is more like 65% now. This is also a very slick way to promote your ad-driven site.

I don't have the link and my memory isn't the greatest in the world, but wasn't there an article in the NY Times recently that said eBay had a 90% share of the market? This week someone posted about a diamond ring, seems that is where I saw that 90%.

I would take the sales as the number to make calculations with and not the number of listings.

I'm not sure if I missed something here, but if you (Todie) are so up-in-arms about this, why you hire a lawyer and sue E-Bay. Why wait for them to come after you?? And if you are so against them, why in heaven would you WANT to be reinstated?

Apparently there are people in here who love ebay and because of this they are blinded to thinking that ebay could ever do any wrong and they blindly support the tyrant. I'm glad someone else also pointed out the erroneous claim that ebay gets only 65% of the market in sales, yes, they may only get 65% of the market in LISTINGS but the sales are over 90% of the market, that is a monopoly, ask Bill Gates. Why do I want me account reinstated? Its the principle of the thing, I was injustly removed from their site. Would I sell there again? Yes I would if they got their act cleaned up on a number of issues which if you went to my site and did any amount of reading you would be able to see that for yourself. Will I go away....no so get used to me.

ebay might lose their traffic but I don't think it'll die completely!

it might come down just for serious bidders and sellers only (hopefully)
