Those are gorgeous dresses, by the way. And I could never ever in a thousand years get into one.

But let us know if you get a response to your email to the rights owner. We're pulling for you.

Thanks! I just talked with someone @ p.s. support. He said something to the effect of**if a vero member says that you are selling copies of their merchandise, eBay has to end the auction". I told him that these were the real thing & had certificates to prove it. He stopped and said "oh, you will definately need to speak to safeharbor then, they will call you back" I am so used to being sooo busy all day with eBay related stuff, I am about to go crazy sitting here!!

The part I don't understand is this....

If you are an authorized retailer and buy directly from them then why in the world can't you use their pics?

I feel you should have a right to all photos current and discontinued for their stuff. Especially since you buy these dresses directly from them.

Ask to speak to whoever is the one with the Ebay account or the guy who trolls ebay looking for auctions to end.

One of my suppliers is close enough that I drive there and pick up my product orders.

The CEO (small enough company that I deal directly with him) was trying to get me to also sell "this" and try selling "that"....They are great selling items that you never ordered from us he tells me....

They have a half-ass website with some horrible pics, products on a table against an ugly factory wall . Pics completely different from the really slick, snazzy ones in there catalog.

I told them I am 100% internet and the ones that have on their site they should be ashamed of.

I also told them I'd be more than happy to also sell "this" and try selling "that". BUT you have to give me copies of pictures that are used in the catalog.

I told them that If I am going to sell their products I feel I have a right to use product pictures produced by them to sell these items more effectively.

I am their only customer that is 100% internet. It made them think.. They know that adult novelties on the net is growing at a pace so rapid NOONE can even create a figure. I guess I was the first customer to make demands.

I got the pics......

They are also changing the packaging on many of their products and creating new lines. I told them I won't even consider selling them until I get new pics as well. They NOW understand completely....

You should make the same demand to your suppliers.... I feel you are entitled to those pictures as you are selling their stuff and making money for THEM.

Imabride2-You sound like a very professional seller. Take a break for a couple of hours. Go to a shop where you can brouse threw a gift gallery or christmas shop to get your mind off of eBay. This helps me a lot. It is very refreshing and then come home and see what you can do. A fresh mind is always better. It is probably going to be difficult since this is a Friday. You will work things out I am sure. Good Luck

Because she doesn't own the rights to their pictures, any more than they own the rights to pictures she creates.

Many of my necklaces, bracelets and rings are ultimately resold, sometimes on eBay. When someone buys one of my items, they do not buy the rights to the pictures. Nor will I ever grant them the rights.

Just file a counter notice..

Ask Ebay for one...
I have filed a few amd always was allowed to relist.

If we are not able to help you resolve the situation, and you still
believe you have the legal right to list the item, you may file a legal
Counter-Notice with us, the form for which we can e-mail to you, and we
will send it to the complaining party. In the Counter-Notice you will
be required to state under penalty of perjury that you have a good faith
belief that the ended auction does not involve infringing materials and
that it was taken down by mistake or due to misidentification.


If you request a counter notice from us, please specify the subject as
"Counter-Notice Request", please contact me for the procedures that you
will need to follow.

it sounds like the issue is not the photos,it is the products she is selling which is in question.
someone questioned if her products are the real McCoy?/
