it's been shown time and time again that many postal clerks don't have a clue what they are talking about.
In the end if there is a problem you will have to answer for it, not the postal clerks as their butts are covered.

kiara posted the rules off the USPS website. Here they are again.


From the USPS website:

123.712 Acceptance by Postal Employee (PS Form 2976)
The Postal Service acceptance employee must:
a. Instruct the sender how to complete, legibly and accurately, the customs declaration form, as required. Failure to complete the form properly can delay delivery of the item or inconvenience the sender and addressee. Moreover, a false, misleading, or incomplete declaration can result in the seizure or return of the item and/or in criminal or civil penalties. The United States Postal Service assumes no responsibility for the accuracy of information that the sender enters on PS Form 2976.

If the package is seized or overtaxed by foreign customs you will be the one that winds up with the chargeback or the whine from the customer. If you are going to run a business act like one. No other legit company would do this for anyone.

This is a very broad statement and open to interpretation but it doesn't say one word about the subject of gift or merchandise. It sounds a lot like that tag on the mattress.

I suppose if you declare the product to be a watch but instead it is a gun or maybe heroin then probably you've broken the law.

Can anyone cite a court case. Surely they must be out there.

Personally, I'm uncomfortable with the whole customs rigamarole! So, all my auctions which are open to international bidders have this paragraph:

"PLEASE NOTE: Many countries impose various taxes, levies, fees, duties, graft, juju, grease, etc., on imports! You, the BUYER, are responsible for knowledge of & PAYMENT FOR any such fees or penalties imposed on your purchase by your country! I have NO knowledge of, NOR any responsibility for any such fees that may or may not be imposed on your purchase by your country! All customs forms are completed accurately & honestly with declaration of the WINNING BID PRICE under the designation "MERCHANDISE"
***NO EXCEPTIONS***
