Hello,

Unfortunately, I do not have any information beyond what I'm given from engineering. I do not have any technical details beyond the fact that the engineering team is aware of the problem and working to resolve it as quickly as possible. We would prefer to focus on resolving the problem, and we will brief you on what caused it after we have it fixed.

We do appreciate your patience while we work on this. We do realize that this is a critical function for your sales.

It is 7 PM EASTERN TIME and still no images and don't delete this post , new people need to know how you treat your loyal customers, which we all feel right now is a very low grade, we sell and do the work to earn our living not because we have nothing elsse to do.

You ddo know that Vendio can track yyour past sales right?

They can go back and look at your past sales. If your current items listed match your past sales to a degree, then yyou draw the conclusion.

Think of it this way. How would a Judge look at it?

Vendio is responsible for performing a service. You pay for the service. They did not perform, it cost you monetary harm. It is a simple contract issue.

Any sane judge will look at any defense they throw against the wall and dismiss it in a heartbeat.

It's a simple contract issue, you paid, they didn't perform what you paid for.

You'll have tto dig for it, but it's available online..findlaw I think

I just had one of many auctions close at way under what they would have with pictures. I realize that you are doing everything you can to fic the problem, but serious thought should be given to some sort of compensation of lost revenue. The auction that just closed at $250.00 with pictures should have closed in excess of $300.00.

I have many others closing in the next hour as do many others.

Yes, Thank you to everyone at Vendio who got the service working properly again.

Now that it's fixed, we're ready to start discussions on the following topics:

1) Why did it happen? What caused this extensive outage?

2) What measures are you implementing to ensure that it never happens again?

3) What compensation will you be providing us for loss of sales?

We look forward to hearing from you shortly.

Knock Knock..are you still there??

How is this going to affect listings that were scheduled through Vendio and just listed on Ebay?

Will the auctions list? Will the photos post once you get your act together?

Advise NOW please.

You have been long on apologies and short on answers.

Here's an idea that I will propose to your engineers and your senior management in a letter; You folks agree that for the amount of time you are down in any function, nobody in the company receives any compensation for said time..IE why should you get paid when you are not doing your job.

If you establish that corporate philosophy, then you are to be commended.
Rest assured I will send my proposal to your Pres and investors along with my complaints from tonight.

Of course there should also be a reward for "uptime"..IE for every 3 months without a bug and or downtime, then reward your employees with time off, Pizza, $ bonus whatever.

Its called carrot and stick.

Advise on the above issues of launching auctions.

Hi all,

As some of you have already noticed, images have been restored. We are still going to be working on the root issue that caused this, so there is a chance that some images may become intermittently unavailable. Thanks again for your patience.

Ok, I have a little detail on what happened, and I've added it to the announcement. Keep in mind, I am not an engineer and this may be an oversimplification. Here is the announcement:

We have restored images and we are continuing to work on the root cause of the issue. The problem resulted from an image server that became corrupted. We chose the less risky path of leaving image hosting offline while we implemented an interim fix that restored data from a backup rather than continue to serve the potentially corrupted data. We feel confident that the interim fix in place now will continue to reliably serve images while we rebuild the affected server.

As you know, we work hard to make sure that our image hosting system is extremely reliable. We have experienced a minimal amount of downtime over the past year, and in the rare event of an outage we are generally able to restore service quickly.

Thank you for your support and your business. We realize how important reliable image hosting is to your business and livelihood, and we hope that you understand that we put considerable effort into ensuring that we are the most reliable image hosting service available.

As noted in the announcement, we are working from a backup and we still have work to do on the system, however, we feel confident that the interim fix is going to resolve the problem.

Danstang - I wouldn't count on that. Bellow is a copy of the portion of the user agreement that clearly states "as is" and "as available". I doubt anyone will see one penny. I bet they stick to the user agreement like glue (kind of like PayPal).



6.2. Disclaimer and Limitation of Liability.


(a) Vendio provides its services "as is" and "as available" and, except as expressly set forth in this Agreement disclaims all other warranties, whether written, oral, express or implied, including without limitation any warranties of title, merchantability, fitness for a particular purpose, and non-infringement. Vendio will not be liable due to outages caused by the failure of public network or communications components or errors in any electronic files provided by Vendio. Vendio makes no representation or warranty that the operation of Vendio's site will be uninterrupted or error-free, and Vendio will not be liable for the consequences of any interruptions or errors. No advice or information from Vendio, whether oral or written, shall create any warranty not expressly stated in the Terms of Use.

(b) Limitation of Liability.

Neither Vendio nor its suppliers will be liable for (i) any loss of business, profits or goodwill, loss of use or data, interruption of business or for any indirect, special, incidental or consequential damages of any character, (however arising, including negligence) arising out of or in connection with this agreement even if Vendio or its supplier is aware of the possibility of such damages, or (ii) any damages that result in any way from your use or inability to use Vendio services, or that result from errors, defects, omissions, delays in operation or transmission, or any other failure of performance of the Vendio services. Our liability, and the liability of our suppliers, to you or any third parties in any circumstance is limited to the greater of (a) the amount of fees you pay to us in the 6 months prior to the action giving rise to liability, or (b) $100. This limitation applies notwithstanding any failure of essential purpose remedy and to the fullest extent permitted by law.

I just launched a bunch of auctions 10PM EST and now there is not a single picture on the autions I just lauched. Not even the box with 'picture not available' -- I already have bids on almost every item, so to pull down and relaunch and attach pictures is going to take a lot of time. (cancel bids, ending auctions, etc.) So now I not only lost bids due to this outage but its costing me even more! WHAT IS GOING ON?!?!?!?!

Apparently the people at Vendio don't know basic math... Here's the response I got to my OUTAGE email I sent them:

Now, I think we ALL know the service wasn't down for just 75 minutes!! It was down from approximately 1:50pm PST to approximate 4:10pm PST. My math says that is 140 minutes... almost TWICE as long.

I would really like an answer to my previous three questions....
