Hi - Need some advice on this. I purchased a Kate Spade handbag a few days ago and received it today and it is a fake! I've been on Ebay for a while now and should have known better, but jumped at the BIN button a bit too fast.
I have a perfect FB of over 1300 (2 neutral, 0 negs) and don't want it ruined over this.
Any ideas on how to handle this without upsetting the seller? (Tootsiepop is not my Ebay ID.)

tootsiepop...if I purchased a bag on eBay and it turned out to be fake, the last thing I would be worried about is upsetting the seller.

Send a very polite e-mail explaining that you received the bag and it is not a genuine article. Ask if their return policy covers this as you would like to return it and receive your bid price back as well as shipping both ways. When you ship it back, make sure you send it certified so you get a signature.

If the seller does not follow through with a return and refund, then politely e-mail once again that you will have to file a fraud report and then do it. Sometimes they may need a bit of a nudge.

--don't worry about a negative. You need at least one to be a TRUE EBAYER
If if you have sold a million and one items--without that negative you don't get a key to the executive bathroom

but if the item is not Kate Spade as advertised----then the seller needs to refund.

Did you pay with a credit card? If so, you could also tell the seller you will file for a chargeback through your Credit Card company if she doesn't refund you.

zazzie - I know it will happen sooner or later, I've just been really lucky so far, I guess I may as well get it over with huh?

Executive girl - I used funds already in my paypal account - pretty dumb I know.

If they sent the merchandise through the US Postal System they can help you in this matter.

If you sent funds from PayPal to a verified seller, you are probably still covered if the seller won't return your money.

I think I would probably make this a 2 part email.

1st part: you want to return the item because it is not genuine.

After you hear from the seller if you do and if she says "all sales final".

2nd part: you are filing with anyone and everyone you can think of!

More than likely you are going to receive an email telling you they thought it was original. The person they got it from told them it was an original......

If you start talking fraud charges before ever giving them a chance to offer a refund, I imagine a "war" is on the horizion! IMHO

If you can't negotiate a peaceful settlement, do not to surrender!

How about telling the seller that you would really appreciate it if they would issue a full refund plus shipping both ways because they were selling a counterfeit bag.

If they say no way, tell them that you will forward their name and address to Kate Spade as a seller of counterfeit merchandise.

how will a retalitory neg ruin your 1300 feedback........if you do not neg, even with a refund, you are a discredit to ebay and you are slapping the faces of all legit buyr=ers and sellers..it is you duty to neg, PERIOD!!

I hope your seller wasn't one of the 4 recently Naru'd Kate Spade Sellers! Looks like there has been a rash of "in an out sellers" for that product. In just the last week!

Good luck, I hate seeing anyone burned. Been there and it's no fun!!

If you paid by Paypal and you do a chargeback, there is a very good chance that you will lose your Paypal account. This is what Paypal reps and paypaldamon both told me when seller sent me the wrong item and refused to exchange or refund. Paypal is no protection at all if the seller sends you anything.

Most of the Kate Spade line retails for $300+
Wholesale to the Retailer is about $150.00.
Why would anyone think that they are getting a genuine authentic bargain on Ebay when it sells for $65? Did the auction listing say
"Guaranteed Authentic".
Designer look-a-likes are sold over the country especially in places like Chinatown in NYC. Not saying it's legal but the products exist because there's a market for them. Our local cable access has an Auction show and the locals recently won several auctions for "Faux" Rolexes at $65.00. Same ones that sell in Chinatown for $25.
Let the buyer beware and stop trying to buy overprices designer bs for half of wholesale.

I understand what tapett is saying but that is part of the fun of bidding on eBay that you get items - even new items that were bought at off line auction/closeout/recieved as a gift/etc and someone is trying to recover some money from them. They may have gotten them for free and you CAN buy items for less than the wholesale cost.

I was not smart enough years ago to start out with a second account for buying so my first couple months I got a negative from some crazy woman who was selling software she did not own to sell, and she neg's me for having the"nerve" to ask for a refund. That is my only neg and I am just under 1,000 feedback.
It IS easier not being a virgin. You don't have to worry about it.

Update - The seller has not answered my e-mails and is now NARU. I took the bag to Nordstroms and compared it to the "real thing" and it's pretty good, so I guess I'll save myself all the hassle and just keep it, (not that I have a choice). I will consider it a lesson in looking before I leap.

Because I used existing funds in my paypal acct, I don't think this qualifies for a charge back, and I don't want to jeopordize my account so I won't try.

Pacoferrone - the seller is already NARU, so it's a moot point. BTW, I have left negs, 7 of them I think, (no retaliatories so far) and probably would have in this case had I been quicker about it.

Tootsiepop -- It is possible as one poster said, that the seller probably though it to be genuine. I'm not a maven on handbags but I am with watches....let me give you an example.
In the watch world there are two kinds of fakes. A Rolex that is seen on the street in NYC selling for 25.00 cost very little to make. It's a cheap fake, everyone knows it's fake, everyones happy.
OTOH I have seen many fakes that cost 3-4K to make. "It walks like a duck and talks like a duck".... These watches are meant to deceive. The wathces genrally find their way into the secondary market via pawnshops.
The pawn is never redeemed and the unsuspecting pawnbroker sells the watch. I've seen it happen many times.

My point is...materials and workmanship should be a factor in speculation of wheather the seller had good intentions.
Given your last post it seems they did not.
