Ok, I had an item end but the winning bidder failed to pay. I filed the non-pay stuff with ebay, waited 10 days, finished up the process and relisted. Now, the item sold on the second listing. Does it qualify for the relist fee refund or not?

No, it does not. This is why eBay 'likes' all those non paying bidders. They still get the listing fee no matter what .
