I just have to vent!! Bought curtains from a seller three months ago with "buy it now option". AFTER she has my $91.00 she says they have to be ordered! So I wait two weeks..no reply to emails..get contact info. Talk to her. Says she's been sick will get them right out. Wait two more weeks. Call ..she says she put the wrong zip on the box and they came back to her.. she'll send them right out. Wait another week..no curtains. Call her work they've never heard of her. Call her home ..line busy.Thought she may be online . Email her. No response.
Next day I get this email:





Curtains have to be returned at a 20 percent loss . Since you refuse to take
item in which you ordered due to a delay ( water under the bridge ). Payment
will arrive by overnight delivery on April 27 th . Thats my husbands
payweek whom which will be dealing with this himself . Due to the stress on
me and my baby this has caused.

Safeharbor on the phone tonight also asked me to forward this to them and
give them an exact date so that no pending insurance claims will go through .
They have given me the option of sending them payment and having them forward
it to you . Thank you.


WATER UNDER THE BRIDGE!!! "Due to return of the curtains".. to where?? She never had them in the first place!! I filed a fraud report. Safe harbor has been no help so far. Ebay did suspend her...big deal. Reported her to Post office and sent claim for insurance. Anybody got any other ideas that might work??
The only lesson to be learned here is if you buy something with BUY IT NOW is to make sure the seller has it to sell!!!

Presales have to be noted in the description.

She probably has to return the curtains to her supplier at a 20% loss for their re-stocking fee.

She had better refund your ENTIRE amount.

After all, you did not ORDER curtains. You hit the BIN on some curtains without knowing she did not even have them in stock.

SHEESH!!

The thing of it is. She doesn't have the curtains to return! She's keeping 20% for making my life miserable!! If she had the curtains she would have sent them. I checked the auction as she ran about 6 pairs of these at once and we were the ONLY bidders on any of this particular item. Even if we had someone else to join forces with it would help..but you know what they say..there's one born every minute... I guess we're it. I was just hoping someone may know of another agency that I might contact. I contacted the national fraud agency and turned her in there too. Insurance (if we get it) deducts $25.00 off the top of final price we paid.. her offer is better to minus the 20% but I don't believe she'll honor any agreement she makes with anyone!! She talks about the "stress this has caused me and my baby". Well if she'd been honest from the start this would not have happened! Isn't there any conscience left in some people?? What about doing the right thing?? Jeepers Creepers!!!!

How did you pay? If it was with a credit card even through an online service you can call the credit card company to have them take it off your account and they will investigate it. If you paid by check you can see if your bank will do a stop payment for free or reduced charge. They may require you to file an affidavit or police report to get reduced charge. Eventually the stop payment will get back to her bank and they will seek to recover the funds from her (but that is her bank's problem, and they may do their own investigation if enough of these happen in a month.) If you paid by money order you may have a way to cancel payment.

I would look into finding a way to cancel the payment and use other companies to get the money back from you. I know that many plantinum cards also have buyer protection in the event the item never arrives. Just tell them that you never recieved delivery and the seller does not have the item because they never owned the item in the first place.

Whether she had them or not, she has no legal right to charge you a 20% restocking fee. They were never in your possession, therefore they cannot be returned BY YOU, therefore absolutely no incurrance of a restocking fee! Sounds like a scam to me. Send the cops after her.

I paid with a MO as she requested as she had recieved 2 bad checks so she claimed. I did contact our local police who were going to call the police in her state just to verify her physical address. But they seemed reluctant to get involved as Ebay has protection for this (right).Since she gave a phoney work number we thought it would be smart to try to verify her address and guess what? She lives in a "gated community". Isn't that special!! So the cops can't go in without permission from the security officers on site. Must be she needs this money for her bank loans,she obviously could afford to send me back the money. I sound like I'm whining now but I am sooo po'ed I can't see straight!!

Hey thanks redeer!!! I checked out that site and I'm sending stuff to ALL of those agecies!! I've got copies of EVERTHING. I'm standing on principal now and that can fuel me for a long,long,long, time. If I have anything to do with it her children will still be dealing with me after she's long gone!!!

Gated Communities are not so special that the police need permission, because the police have the right and duty to investigate crimes without having to get permission. If a huge fight occured, does that mean they have to wait until the security rent-a-cops? NO! Unless the gated community has a municipal charter from the state, they cannot restrict police officers from entry to investigate a crime. (That also means that the gated community would have to provide deputized police officers and fire protection, along with other services as required by state and federal laws) However, the property owner can tell the police officers that they will not allow the police to remain on their property, nor do they have to answer any questions asked (5th amendment). Of course, they could sue the gated community for obstruction of justice.

It may be 100% true what they tell you but it just doesn't make sense and is unlike anything I have ever seen. All of the local gated communities I know of receive police and fire protection from the city they are located in, and the police have full access.

rdecker: I once got burned by a seller on ebay. It was a dutch auction for Sony Mavica cameras. Final bid $400. A good price at the time. I had never spent more than $30 on ebay and was real nervous about spending this much. But the person's FB was excellent. Just as soon as my money order was mailed the guy started racking up the negs from ALL his recent auctions. Seems all his stuff was presell (not disclosed) and his supplier was unable to fill his orders. The guy had over $40k in MO's and none of the merchandise was available. Wouldn't answer the phone or email. His bidders banded together and we got him kicked off ebay for bad contact info.

The reason I'm telling you is that I used the same link posted here and I complained to every agency listed there and more I found on the internet. (search dogpile using "internet fraud" ) I also wrote to the Attorney General in his state AND my state with copies mailed to him. I wrote letters of complaint to the fraud unit of his police dept. I wrote to Consumer Affairs Dept in his state. I filed Mail Fraud charges. Everytime I filed a complaint with someone, I sent him a copy.

Bottom line, my camera arrived 8 weeks after the auction. My seller lives in CA, and the camera was postmarked Chicago. I don't know how I got it, but I know why.

Don't give up, and make her trip to the mailbox everyday a living hell, wondering what you are going to do next.

Everyone has been so helpful!!! Thank you each and everyone!! I have a feeling that because it's only $91.00 and I'm alone in the boat that I'll probably never see the money..You folks have made me feel like I'm not so alone!! You've certainly been more help than Ebay!! My local D.A. has offered to write a letter. I will flood her with letters. But I have one more question if anyone knows it. How long will ebay suspend a member for??

This just goes to show you how different two sides of a story can be.............interesting how different they are and the details left out ~ that you only get from one side or the other. What a freaking nightmare. I wonder what details are missing from both sides.

In looking at the Seller's other auctions, a few facts stand out:

1. She states the auction is for a particular size curtain and implies she has them in hand, but can order different sizes.

2. She gives a choice of color and size for the curtains. (is this a choice auction?)

3. She states "Satisfaction is guaranteed".

4. She states she ships the day after payment is received, except she holds checks for 5 days and then ships.

5. Seller's feedback shows recent problems with at least 2 other buyers (one neg, one positive but with a comment about slow shipment due to health problems).

6. Seller is still listing auctions. (so are the health problems now resolved?)

Under the circumstances, I can't imagine why she wouldn't honor her own terms and refund the buyer's money in full.

I am the one, who left a negative feedback on this seller and this is my story.
I bought the darpes from her.
When I got them, I did not like them at all. In my opinion they were misrepresented. I sent her e-mail, saying that I did not like the item and wanted to return. She wrote back, saying that she will let me know, when she will receive it (did not mention anything about the fact that she would not take it back and it was not in a description either).
I paid $8.00 for shipping and return receipt, know for sure that item was delivered to her 3/31.
Sent multiple e-mails asking to let me kow, when I will get any money back and just asking to reply to my messages.
The last Friday I sent her e-mail saying that, if she will not reply or send me money before Tuesday 4/24 (almost month after return was received), I will post a negative feedback.
Nothing happened and I did post negative feedback. Immediately after she posted negative feedback on me with false information.
I don't think such people should be allowed on eBay or any other site.
