I just found that another seller is using my pics for her auction. My auction ended a bit over a week ago. My pics are no longer attached to my auction, so I can't just delete them. IS this against ebay rules? Will ebay do something about it?

Yes, eBay will do something about it if you complain loud and long enough.

eBay will only do something if you complete their VERO process.

Remember, they're only a venue.

Wrong.

And here's why:

When is my work protected?

Your work is under copyright protection the moment it is created and fixed in a tangible form so that it is perceptible either directly or with the aid of a machine or device.

Do I have to register with your office to be protected?

No. In general, registration is voluntary. Copyright exists from the moment the work is created.

eBay Guideline: No Copying Allowed! When you prepare your auction listings you generally should use only material (text, photographs, etc.) and trademarks/names that you created or own yourself or licensed from the owners.

If you copy someone else's auction text or original photograph, or copy text or photographs from any other place (depending upon how much is copied), you may be infringing someone's copyright.

Register your photos and you can make a handsome reward each and every time someone infringes your copyright.

same thing happend to me econ is correct register as a vero member and you can end his auction instantly
Ebay will do nothing otherwise.

The advice that it is legal to use any image off the Internet is not right !!!.


You can not freely copy and use any image in less there is a statement on the site that tells you its ok to use the text or image and then most will ask where ever you use it you give a link back to there website and give then credit for the work.

Most of the same common Ruleings work the same on the Internet as they do in the B&M world.

Takeing some one elses Images from an auction and useing them for your own sales is the same as someone entering your garage Just because the door was open and they could get in and takeing family photos and showing them off as there family.

Every Auction Has a starting date on them this is good enough This is all it takes to claim copyrights to the basic description photos of your auction.

How ever the cost of the battle over copyright for an auction Item may make unaffective to fight it.

Vero is an ok sulution but for catching maybe one in a million or more auction that might use your picture is it worth it ????

Most people dont spend hours looking for these things they run accoss it by accident one in a blue moon.

Saying its legal to take any Image off the web is ok is just silly I supose its ok to take Names Addresses Email addresses Credit card number SS# Just because they are there and some one say there is no copyrights on them after all you know a credit card number and SS# is just a number numbers are free for anyone to write down and use we all do math freely daily.

Its theift and Fraud, theift & Fruad cost bussiness and consumers large and small billions and billions every year.

Please use my favorite remedy:

Replace the pix with those of nekkid women ~ or any other x rated photo you can find. Make it REALLY disgusting.

You then have two choices:

1. Report the auction to safeharbor for really disgusting x rated pictures

-or my favorite-

2. Sit back and laugh your butt off!

I took this advice when someone was using my pictures and hosting service for their pics. I replaced them with the most raunchy bizarre pornography you could imagine.

Needless to say Ebay permanently removed them.

That delightful scenario only works if they are using a link to your hosted picture. If they have downloaded the image to their computer and now use ipix or their own hoster, I think you're kinda SOL. If it's not ipix, right click on the picture and check properties to see if the picture is from your host or not.


Without eBay, I might have a real life...

Yeah, some online store in Germany stole my picture I listed on eBay. He was using it to sell the same item at his store. His reply to me after I asked him to remove the picture was, "I didn't think you'd mind". Of course, he never asked so I didn't mind.

Anyway, are there any image processing programs (free?) that will stamp a copyright into your image automatically?

I am on my third Sony Mavica!!! I take a lot of photos (I am down now because we were in NM for about 10 days)...

I sell mostley one off sort of items... Yard sales, flea mkts, junk shops and so on...

I might be missing the point but I could care less if someone uses my photos if they wait until my auction is over... I know I use a lot of copy and other information that I run accross trying to research items ~ such as age and specs.

Hope I'm not making anyone mad enough to come to New Orleans and poke me in the nose!!!
