I am having a problem with some stuff I bought on ebay and not sure what to do. I figured maybe some of you nice people on here could help me. Last month I purchased 6 packs of first edition pokemon cards on ebay. (Yes I am still one of those wasting my money on pokemon, not sure why).

When I got the cards in I opened them and then noticed later that they were not first edition packs but unlimited edition. I immediately called the 800 # they provided in their end of auction notice. The guy I talked to informed me that he was 100% sure the packs couldn't have come from him because he had never had any unlimited edition cards from this series in his store and since the packs were opened he didn't know what I wanted him to do as he can't take them back open.

I then pointed out to him that he has a feedback from with in the last week stating something to the effect that the store had sent the wrong packs but quickly corrected the problem and that this person had bought the same first edition packs as I had so apparently I was not the only person who received the wrong type of packs from him. Then he told me he will check into it and get back to me probably some time tomorrow.

I am not sure what to do next. The way I see it I am due either a full or partial refund. I admit I should have noticed the packs weren't first edition before I opened them. I am trying to be fair about this but not sure what fair is. I paid for these with my credit card directly through them. Should I (or can I) do a chargeback if the seller refuses to work with me?

Well I think first of all I would simply sit back for a day and wait to see what the seller offers to do. You might be jumping the gun just a little bit and perhaps he will refund or send the other cards to you.

my friend,

rule number one-you cannot chargeback what you have in your possession,which means you must return them first.
but you said you have open the cards and seller said this is a no no,so even if you return the cards,he will fight you on the chargeback for that reason.
your best bet is to work with the seller and see if he will accept the return and issue a partial refund or replace it with first edition.
do you have a copy of the item description where it said first edition?
it all depend on your seller,if he insists you had played a game of switch-a-roo,then you are out of luck,keep the cards and give him a negative feedback so others know.

I paid for these with my discovercard. I called the store over their 800 # and gave them my credit card info so it was paid for through their merchant account. I am going to give him a day to respond and then offer the following compromise. If it turns out that he did send at least one other person the same type of unlimited cards as me, I think I should get half my money back. Does that sound like a fair compromise?

To me that seems very fair to both of you.
He's lucky to have a customer who is willing to work out a fair solution. :0)
