Can't help but wonder if there is any resentment involved on NYC's part due to a certain someone getting a lot of personal publicity and promoting her company with the suggestion of substancial funds being raised that did not materalize?
Not that the issue doesn't have merit on it's own but NYC's tone and attitude seems extra harsh.
Maybe all the talk show apperances have left a bad taste in some peoples mouth.
Then again, being born and raised in NYC, I realize we are sometimes just misunderstood for our manner of expressing thoughts.

I think they have a point with the unauthorized things like NYPD and NYFD logos, but I find it amazing that they would have a problem with me selling a postcard from a few years ago that shows the WTC.
I agree some items are in bad taste, but I don't think that the mayor of NY should determine this. It scares me that he thinks he should be able to do that.

As the law prof said, I think NYC's claims are mighty slim.
I also have a problem with govt entities owning trademarks. There are other ways to protect names, such as fraud, to protect terms such as NYPD or NYFD. The only time there should be an enforcement is when the symbols are used for fraud, such as emblems used to officially identify someone as a member of the NYFD or NYPD.
I live in the vicintity of a majopr state college and they have trademarked their stuff- as nearly all stste colleges have.
Every year there is someone arrested and t-shirts confiscated for depicting their "logo" or shirts with artwork depicting the teams having at it.
These shirts are an artistic rendering of a rival football match. The govt shouldn't be allowed to own the trademarks and quash political/artistic speech.

I dont think anything should be banned on any auction site. If the stuff is too extreme for basic auctions make users give a CC number to see it. There are things I dont like too but I cant force ebay to get rid of it.

I agree with Blairwitch. Although some things are tasteless, they shouldnt be banned unless of course its illegal or stolen in the first place. It's what makes this country what it is...a place of freedom. There are lots of things in this country that are indeed downright wrong (KKK for example) but are not illegal (that darn freedom of speech) and I believe that should be addressed first before some memoribilia of a horrible event is sold on ebay.
