I recently bought a $900 item off of ebay and FedEx damaged it in shipping (or at least the seller says it worked before shipping). I contacted the selling with in an hour of getting the package to tell him that it was DOA even called to find out the price on repair ($1200 much more than it's worth). FedEx came and picked it up ask me some questions after the seller filed a claim (it was insured threw them) and then told me I'd have to wait to see what happens. He will not respond to any e-mails about a refund at all but does respond to questions about FedEx and the claim. His auction stated No DOAs. What should I do this has been going on for a week now with him only talking about FedEx and that they are looking into it.

Edit: Ok now I'm kinda worried. Just went threw the hundreds of feedbacks and found 5 other people that got DOA products and were never resolved from this person.

this happened to me recently I WAS THE SELLER and their is good and bad news. fedex damaged 2 printers shipped on same day before xmas they got REALLY bashed around i am guessing because of the xmas rush. Anyway as the shipper only I could claim the damaged item then fedex advised the payment had to be sent to me it took a long time to sort out had to call fedex ALOT and send alot of doucmentation finally this week they sent me the 2 refunds at the same time! I then in turn refunded the buyers and both are now happy as they kept the printer that was slightly damaged but still worked and got a full refund. I am happy because the buyer is happy and no one lost any money. However this does not help you case as the shipped has to claim and will more than likely receive the settlement.

Yeah he is the one that filed the claim and they won't even talk to me about it. The item is also totaly unsueable because of the damage and FedEx has the item. They called me by mistake once thinking I was the shipper and ask me if I wanted it shipped back to the seller or shipper to top it off. The seller claims that they have never called him about it and that all they tell him when he calls is that they are looking into it.

Wouldn't you think that since I don't have the item and FedEx won't even deal with me that he should just refund my money?

Edit: it seems kinda odd to me also that I know they called him to find out were he wanted it sent cuz they called me first by mistake.

ok here are your next steps how did you pay? credit card via billpoint or paypal. if so you are in luck just tell the seller you will file a chargeback if this is not sorted out. ie he files a claim with fedex soon as he files the claim you can then call fedex and check status however he/she must initiate the claim

Payed with paypal and the claim process is already started. When FedEx called me by mistake they told me that they inspected the package already. What ever than means.

BTW what is a charge back??

hehe feel kinda silly about this whole thing, never had an auction go this bad. Had one end with a DOA and the person refunded my money the next day and I kept in touch to find out if he got his money from the UPS claim too (and he did get his money back threw them).

Just feel lost in this transaction

Awww found it on paypal's website. hehe a little cut and paste of that and a few other things seems to have gotten his attention too. Thanks for the info I think it realy helped. He responded to that e-mail in like 15mins. Only took 9 days to get his attention though
