I bought a food processor on ebay. It was sold as brand new never used in original box. When Item arrived it was used with food stuck all over the inside, no box, no instructions. I immedatley wrote seller and was told I should expect a refund. 3 weeks go by no refund. Now seller is saying only going to refund half of money even though item was totally misrepresented. And wants to charge me $15 for shipping. WHAT CAN I DO? If I leave neg feedback he'll just do the same to me. Im not going to buy any more on ebay this is the 5th time Ive been ripped off.

How did you pay? If you paid through Paypal you can do a chargeback. I'd leave a negative for the seller (he obviously wont work this out with you)

Contact safeharbor first. See what they have to say on the subject. Then if he should Neg. you,you will more than likely be able to have it removed.

Did you look at this seller's feedback before you bid? If they would pull a stunt like that with you, I doubt it's the first time. Tell us about their feedback please. Some of the responsibility of buying on ebay rests with the buyer... I'm not saying you didn't get ripped-off, I'd just like some additional facts. Care to post the auction number?

Did you print out a copy of the auction. You will need to do that for legal purposes. You may try to find in ebays terms about selling items and sending something other than what was represented and forwarding it to the seller and to safeharbor. If the person is reasonably close to you, you could go to court. If not, see what ebay can do for you. Otherwise it appears that this seller was just a mistake for you.

if he paid using a credit card he can do a chargeback with his credit card company. PayPal won't do anything for him though. They don't do anything about misrepresented items. Only if it doesn't arrive at all.
You can file for eBay's insurance too. Even though there's a $25 deductible, so you probably won't get anything, if fraud is proven it's still on his record.
