Just saw a closed auction where joe-seller has item for sale.....at the end of the description, he states " This item is pictured on auction #xxxxxxx."
So, what is this? The correct way to use someone elses picture?

He sounds like a newbie who may not even know how to add pictures to an auction and is hoping that buyers will take the time to locate the auction he mentions and look at the picture.
Frankly, I doubt most buyers will take the time
to do this because many buyers don't even read the entire auction description to begin with.
To be fair to the seller, he isn't really
stealing anything.
Is the auction that he mentions running at the same time as his own? If so, I feel
kind of sorry for him because he
could be taking traffic away from his site and directing it toward a competitor.
