Before everyone tells me to bid on a spelling check, or ask me if i'm 4 years old. I just wan't to ask a question. I make all my wigets, in my EOA email, can I say " to upgrade to &&&& add $+++, to upgrade to %%%%% ad $))))", or get them your way . Or do I have to sell them as in auction?? TO the nice people out there, THANKS

According to ebay it would most likely be fee avoidance as they don't get a cut. Your customer may be happy to get a better product for a higher price and probably wouldn't be talking to ebay but it's a chance you take.
Do you also offer the upgraded ones on your auctions? I guess you could mention in your EOA that you do have a better one and see what happens. Like I said, it's a risk.

eBay may claim it is fee avoidance. But, your EOA email might be viewed as a private business communication and is none of eBay's business.
I include other items for sale in my EOA and offer free shipping if MY customer adds another item. I consider this a private business communication with MY customer and if eBay interferes, I'll test it in court without hesitation. 40% of my sales are from MY customers adding items from this email.
