I know when you come in here and ask this question the answer is probably no. but here goes.
I have a video that says on the black plastic case, "For distributor promotional use only. not for sale, rental, duplication or public performance."
I also have one that says "The copyright proprietor has licensed the Picture contained in this videocasette for private use only and prohibits any other use. I am sorry it doesn't say I cannot sell it only I can reproduce it. I wouldn't do that.
Since I am not a video seller I have not seen that before does that mean I can't sell it? Any help would be appreciated.

Libra, I have never sold a promotional video but I have sold promotional LP's and there was no problem with that. The only thing that would happen is ebay would stop the sale if it were a violation. And they would only do that if someone turned you in.

I have heard of many people selling the promotional videos. (usually review tapes for hollywood unions) I haven't heard of any problems.
Under a cursory glance, I did find this quote on the help pages for ebay.
"eBay policy does not specifically prohibit the listing of promotional items, but you should be aware that many rights owners take the position that the listing of such items is a copyright infringement. Listing such items could therefore result in the ending of your listing if a member of our Verified Rights Owner (VeRO) Program reports the items as infringing their rights."
This quote refers to promotional music specifically.

The reason I bought the video because I wanted to see it. It is Traitor Within with Timothy Hutton but then I got home and saw what it said on the inside label. It's about Aldrich Ames of the CIA. On the label it also says The original Full-Length feature. I think it should be really good. Thanks everyone for your help. After it makes the rounds of my family I might just try it on eBay.
The other one I bought about the Beatles some one from england has it on. It is a tape not sanctioned by apple or the beatles.

I think the only one's who can't resell it are the one's who originally received the video for promotional use. If they got busted reselling it they wouldn't receive any more promotional videos. I seriously doubt ebay would close your auction over this as it doesn't violate a patent.
The other video, "for private use only," just means it can't be used for showing your neighborhood movie party for admission. You can resell it. This copyright applies to all videos and books.
Everyone is entitled to my opinion.
