I won a Nintendo 64 game, strategy guide and expansion pack. It came UPS, in an envelope and only had strategy guide and the empty game box in it.

I wrote the seller and this was his response.

***** "Yeah and down in the bottom of that package was the expansion pack and game. I tripled checked it before I sealed it. If you got the package unopened the game was there." ******

I paid through PayPal and actually took out insurance on this because of the price. I usually don't. So I then requested the insurance information to let UPS figure out what might have happened and this is his response.

***** I do not participate in insurance fraud. I'm sorry if you didn't like the game when you got it but that's life. I know you got it. Please do not contact me anymore as I will be forced to press harassment and mail fraud charges against you. As of now I am no longer permitting my email to accept mail from you. If you contact me again, my wife who is a Chicago police officer has advised me that I may press charges. Thank You. ******


I somehow think I'm not going to resolve this with the seller, I don't think 2 e-mails constitutes harrassment. I'm going to try getting a refund through PayPal. Wish it had been credit card instead of cash.


Is there anything else I should do. I can't do any fraud with E-bay for 30 days. He will definitely be getting a neg from me. He only has 52 feedback and mine was only his second sale all other were as buyer. Not worried about the retalitory neg I'll be getting back, it will be my first out of almost 2,300 and will almost be a relief that I don't have to worry any more about getting one.

Anyone who uses UPS, do they mark anywhere on the package that insurance was purchased? Nothing on this package.

Everybody is doing maintenace tonight so I have a little time to cool down before proceeding. I used to use AW before they started charging and been reading the boards for years, so decided to sign up and get the best advice available.

Check Paypal's site. Although I haven't had this sort of problem, I know Paypal may freeze a seller's account if they suspect fraud, per your reports to them.

I don't think insurance will cover the missing game. If the package was still sealed, it's likley he just didn't send it. Insurance only covers loss or damage while in transit.

The main thing I see is that he appears to be trying to use force as a bully to make you go away. Why else would he mention "his wife is a police officer"? Me thinks he protests too much to be an honest seller.

Two emails do not constitute harrassment unless you threatened him. If you did threaten him, it would explain his forceful emails. But your posting doesn't seem to indicate you are that type of person.

First one:

Just received the envelope today.

It only included the Strategy Guide magazine and an EMPTY Donkey Kong 64 Box.

NO GAME.

Please Advise.

Second Note I sent about insurance:

I will need the information for the insurance that was purchased with this game.


I was hoping first note would get a response that he had forgotten to put it in the envelope. But from his response I knew I wasn't going to get anywhere with him which is why second note was so short.

Insurance is free up to $100.00 on any UPS shipped item. The seller must initiate any insurance claim through them.

Contact Paypal about the problem and if you used a credit card, start talking to your company about doing a chargeback.

Definitely leave that neg as soon as possible. That may wake him up. I would also email him through "send this sale to a friend" option. Tell him you are reporting not only his fraud but his threats to ebay.

this seller is just hoping his threats will make you "go away and leave him with your money"

Actually, I'd hold off on the neg. That's one of your few remaining bargaining chips to actually get your game. (I assume you still want the game.)

You might want to pull his contact info and send him a registered letter with all the details, including the obvious inconsistencies in this own story. I don't know what the packaging looked like, but why would he pack the box and strategy manual in a bag, apparently separately from the game and expansion pack? (He said they were "down in the bottom." Are you sure he ever had the game? (Did the auction include a photo of the game, or just the box?)

In the meantime, do go ahead and contact Paypal and eBay.

And if you just wanna mess with him ... assuming his wife is a Chicago police officer, using her position to threaten her husband's customers would be of great interest to Internal Affairs. You could certainly make the case for a perceived attempt to intimidate you.

It sounds like the harrassment is coming from his end. He has threatened you with the statement "His wife is a police officer in Chicago". What I would do is to be the first to contact eBay so that when your seller contacts them you have the first word and eBay doesn't suspend you. I find your emails brief, to the point and not threatening. Is there mail fraud if you use UPS? Also the statement that he made "he triple checked it before he sealed it" That sounds strange to me but that might be what some sellers do. I don't, I only check it once seal it and hope that what I sold is in that envelope. Good Luck

Actually, the seller's return address should be on the package, or in the EOA notice. I was mainly thinking about the impact of the "so-and-so has requested your info" email from eBay.

The part I was really serious about was the "good luck" part ... I hope it works out.

(just out of curiousity, magneticattractions, how does that work? I Google'd my number and (fortunately) neither my name or address came up.)

paypal does not get involved in content issue,but this will change starting march 7.
if he has shipped ups,right now all he has to do to to prove to paypal he has trackable delivery confirmation online and which he did if he has shipped ups.
what about the weight difference?
can you get the weight data from ups??
you will also be covered by ebay up to 200 dollars with deductible.

if this item was infact shipped via UPS...you can goto www.ups.com and file a claim yourself for the package even though you are the buyer.

fill out the form....ups will contact the seller and will get back with you with more info.

I'm listed, but it didn't work. Maybe it only applies to certain phone companies. A potentially useful resource nonetheless.

I have the reverse directory also, but google is so much easier. My sister said hers didn't show up, but I put her number in, and there it was..right at the top. She was looking in the area where it looks for a website, and it said none was found. No idea why yours won't show up...I haven't trun across one yet that didn't, from all over the country.

check paypal site and see what happens if you return the item back to this jerk.
make sure you package it in some way which does not arouse his suspicion.
if he barks,then said look down the bottom of the box and you will find bla bla bla
!!

Dragon - As a current employee of a federal government agency and a prior employee of a state agency, I can tell you that this seller has done the unthinkable - threatening you with his wife's police position.

Any federal or state employee that would do this would be automatically fired upon the violation being reported.

I suggest you do a charge back through Paypal and let the seller know that you are filing a report of his threat with his wife's employer. Then follow up and file the complaint.

i dont think he can do chargeback,he used cash in his paypal account.
