Sold item to buyer, stated shipping in auction, No need for any emailing, He sends pay pal, I ship, end of story. So I thought.
2weeks pass, I get feedback, Neutral,Won't give feedback till given first. (LOL, Which only makes perfect sense, what if it were smashed to pieces? Never gets it? Wrong thing, you all know on and on)
I e mail him congradulating him on his soon to be NEGATIVE.
He writes nasty response. I thought,,,,, did we have a cat fight e'r something before? I check e mails, Nothing, his pay pal and my ups number to him.
I wonder, who am I dealing with? check it out. lots of feeds all pos. hmmmm, buyer sells too! what's he sell? WHAT!!!!! My Auction!!!! picture and word for word!!!!
I contact e bay,,,,,LOL, I just got the "VERY" canned response, auction has been removed. period. No comments, nothing. not even a real person I am sure.
NOW! my question is, FEEDBACK to him. Of course he WILL get the DREADED Complaint but! (his stealing my auction far outweighs his sneiveling about feed back.
I would like some creative ideas of what to say. He HAD a perfect Score. I have mine in my head including the auction number to be posted right in the feed back.

Give him a negative.
The stealing images and/or auction content rarely matters to ebay as you may have stolen it from another ebay in the first place. Ebay shies aways from content theft issues. On popular ebay items there are dozens of sellers using the same photos and exact descriptions and titles. It's a lost cause.

Auctionace - not entirely true. I had a competing seller stealing my photos and descriptions. I reported them to Ebay and had the auctions ended. The idiot kept doing it and after the third complaint I filed, they were NARU'd.

Unless of course they are dumb enough to use your hosted images where you can bust them on theft of bandwidth.... or really have some fun be replacing the image. I used to replace them with a note explaining that the seller was a scumbag and pointing the back to my site and auctions.

Not true all the time. Sometimes ebay will surprise you and do the right thing. I would report it, just stick to the facts and give them all the info you have.
If they do look and see that you have had the descripion and photos in other auctions there is a good chance they will pull the lazy thiefs auction.
Put this loser on your email and bidders block so you do not have to deal with them again.

I have seen ebay do this several times so I know that they can remove the auction if you complain and show proof that you used the picture and description before the thief did.
As far as feedback to leave him? He probably does deserve a negative but I'm not sure how you would word it. Maybe along the lines of "WARNING Stole my pics & text..." ?

I have every intention of negging the low life scum sucker. I just ask for some creative verbage to go with it. What would you all say in the Negative feedback? e bay KILLED the auction without question.

REAMOND - All of my photos were copyrighted and I had filed the VERO paperwork with Ebay. All I had to do was file the complaint that they were using my copyrighted photos without my consent and the auctions were ended immediatley and with no questions asked. They had alse copied my descriptions word for word so that the auctions look very similar. It was very cut and dried from Ebay's point of view.

And all the "infringer" has to do is file a counterclaim and you have 14 days to file in court in the "infringer's" jurisdiction and if you don't, eBay will allow the "infringer" to relist the material.
eBay is not offering you any protection that is not required by federal law. All you need to do to get material taken down on any ISP site that is infringing on your intellectual peoperty rights is fill out the proper information under penalty of perjury and send it to the ISP and they either take the material down or face vicarious liability. That is all VeRO is and the same system applies to all ISPs.
And all the other party has to do is file a counterclaim.

The picture seems to overide my feed back question. My picture darn near has my very signature on it. A tough one to disprove anywhere. Darn near? Not! On second thought, it has my Title right "in" the picture!
I just want some good ideas for the feed...He's a crook, plain and simple. E bay killed his auction......I like the "lite" approach ideas,,,,,Johnny! you've been a bad boy! auction theft is NOT nice, shame shame on you. Now go to bed with NO supper!

REAMOND - And your point? The system you described has worked perfectly for me. Everyone that has stolen my intellectual property for auction purposes has had their auctions ended, period. No couterclaims because they know good and well I can prove they stole it. I never said I have some "special protection" from Ebay. I just followed the procedures for filing the complaint and the problem was resolved quickly.

I simple email, stating that your images and text are copyrighted, and that they have to pay you royalties for the service should hopefully do the trick. As a professional photographer, I can tell you your rights are quite limited.
You would have to do more than what it is probably worth to take care of the problem. I am guessing they weren't satisfied with the product, and instead of keeping it, they decided to sell it.
I had someone stealing photos from me as well. They ignored my repeated emails, I contacted ebay, and they were so slow that the auction ended before they did anything.

Still looking for some creative feed back. He bought from me, cried that he got no feed back, then steals my auction completely. The product he bought was brand new ! I had NO previous convesations with him. I feel he only bought to to cry the blues. why? ya got me? but! He will get a NEG! He can count on that! I just want to say in the BEST way possible pointing to him as the theif that he is and giving me a nuetral, his statement is,,,,,Won't give feedback till the buyer does,,,,,,,whaaaaa!!!! whaaaaaaa!
