I need some advice. Can I sell professional haircolor on Ebay and have my TOS as "sold to a licensed professional only"? I know that the average person will not need or want 50+ tubes of haircolor,but I would like the buyer to give me their cosmetology license # before I will sell it to them. Can I get in trouble having this rule?

Ebay won't care but you may have a problem getting a buyer. Why do you care who buys it and why do you think someone is going to give you their license number?

The professional hair industry has a huge problem with their products being sold blackmarket to the nonlicensed consumer. I don't want to contribute to this problem. This haircolor is not formulated or packaged with instructions for the average person to use. I am a licensed cosmetologist and wish to sell to the same.I just want to make sure Ebay is okay with me having this rule. Sounds like it will be fine. Anybody disagree?

I am a licensed cosmetologist also and have thought of selling the professional products. But why in the world would someone who is licensed want to buy something and pay postage for it when they can either drive to their local distributor or call them and have it delivered UPS.

It is only the non-professionals who would want to buy the products, especially haircolor, since they can't buy them at the local store without a license. I think this would be considered bootlegging by the makers...I don't know. Also they can go to their local grocery store and buy most products. I was going down the shampoo aisle at the HEB (grocery) store last week and couldn't believe the professional products available. The only problem is they are charging the same prices the salons are charging so they don't save money they just save a trip to the salon between haircuts.

I have seen several sellers on ebay selling OPI polish and other products but they don't make much profit since our costs are so high now. I think you could do fairly well selling professional haircolor but only to non-licensed people. IMHO

Actually, if I could get 50 tubes of my haircolor I would love it.

But I am not a licensed professional.

dlegoflamb: If you decide to go with the "sales to licensed professionals only" route (and I am not saying you shouldn't) what will happen is that many of your winners will not be professionals.

Then you'll be stuck for your listing fees, even if you file for final value fees.

But one thing you can do is create an approved bidder list. I really think this would work well for you. eBay has a function where you can accept bids ONLY from certain pre-approved bidders. To be able to bid on your auctions, a prospective bidder would have to email you their cosmetology license #.

Thanks Fluffy! That's exactly how I'm going to list this auction.
Paws,this is just a one time sale. I've closed my shop and am moving out of state. I'm actually going to take a big loss on the product. I could of taken the some of the color back to the beauty supply to get my money back, but some of the color is the old packaging, discontinued shades, and partally used tubes. I just want to get rid of it all at once. Somebody is going to get a good deal!

It is kind of like buying freon. You can only sell it to a licensed professional. Go ahead and put it in your auction and good luck.

If you sell in the health care catagory, ebay requires you to put that in the description.
This is ebays suggested text:

The sale of this item may be subject to regulation by the U.S. Food and Drug Administration and state and local regulatory agencies. If so, do not bid on this item unless you are an authorized purchaser. If the item is subject to FDA regulation, I will verify your status as an authorized purchaser of this item before shipping of the item.

They also require you to put the name of your bussiness and address in the listing.

Since it is a one time sale you might do ok but still take a loss. Have you ask your distributor who you bought them from if they will take them back? When I sold my salon 12 years ago my distributor took a lot of my retail and colors etc. back. Sometimes they won't actually pay you but give you a credit for what you might owe them on a bill.
I bet you will sell them on ebay though.

When I quit the business in Dec of last year I sold most of my nail supplies, I quit doing hair when I sold my place, but I did take a big loss on most things. I have over 300 bottle of polish. I ended up selling them at a garage sell for a better price than on ebay. However haircolor is different.

How are you going to make sure the license number is legit? Can't someone just get you any number and you can't prove it. I would think the only way would be for them to scan their license and driver's license then email them to you to prove they truly have a cosmetolgy license. Hope you make at least your cost on the color!

I am not a licensed professional and would never dare try to replicate the formula my hairdresser uses on my hair ... but when one of the products I really liked was dropped by the local distributor, I did go on eBay and snagged a bunch of it after asking my hairdresser the color names I was looking for. I bid (she was not an eBayer at the time) and then she started making all these elaborate preparations to prove it was going to a licensed professional. She was completely appalled when they never even asked. Her statement was "This line is tricky to use even for professionals."

One suggestion -- you might want to break out the discontinued shades into their own auctions. I lucked on to a bunch of new Estee Lauder lipsticks, about half of which were discontinued shades. Those sold for 2-3 times what the current shades sold for, and in a few cases well over retail.

Ebay is "only a venue..."

But they'll stick their nose in your auction if they think it'll affect them...

Well, I did what Fluffy suggested and listed the auction on a preapproved bid basis . Sure enough, an hour later I got someone asking for preappoval. I went to their state's licensing website and found a way to look up their #. Looks like it is a Cosm. student. Since the person didn't give me their name with their inquiry, I emailed them back and asked what it was so I can positively identify them. I'm waiting for a response.
I probably should of listed the beige colors separately because they are discontinued. I'm running out of time, I'm moving on June 25th.As it is I had to make this a 5 day auction. Why do I procrastinate!?
