Was just browsing through active and completed eBay auctions in categories that I plan to list again when I discovered that a seller is using my pictures from a completed auction from months ago in which I sold the item to them. They must have saved the pics to their computer and renamed them and then uploaded them to their image host. Generally I wouldn't be this upset over it but I still have two more of the same "exact item" and I want to list AND use my "same pictures" which are stored in my Vendio Images. What should I do about this situation??

You best bet is to communicate with the photo liberator and explain to them that you want then to take down the photos or you will report them to ebay. The next best thing is to start putting a watermark on your photos for future cases. The watermarks can be erased but most photo liberators will not go to the trouble of doing so.

Send the following link to the seller and tell them if they continue to use your pictures you will report them. I think all you have to do is prove to safeharbor that the pictures are yours and you can do that by directing them to a closed auction you had. Good Luck. Go get em.....

Set up a throwaway buyer's account and put in a proxy for $1000.00. You will win the auction and he will send you an eoa with his name and address. Go to his house and kick his ass.

Don't know if you've already emailed him but ... if this is a former customer of yours selling something you sold him, I'd maybe take a slightly moderated approach.
First off, this guy only has one of these, right? I'd email him and explain to him that you don't usually let people use your pictures, especially if they were taken w/o permission, because you sell the same item.
But in the past, I have let my own buyers use my pictures to resell just that item they bought from me, as long as they gave me credit in the auction text. As far as timing goes, it shouldn't be a problem as long as his listing expires before you plan to relist. I am not saying you have any obligation to let him use the picture ... but I think it would be easier to make an exception if he's selling something he bought from you.
