After 3 days of no contact from the winning bidder, I believe I can relist the item or offer it to the 2nd highest bidder. Can I still file a NPB alert and also file a FVF on the first listing if it is sold to someone else??

The answer to the filing is YES.

I'd relist on the 7th day.
You need to send the reminder first.
If it's a Christmas item, it's debatable about relisting sooner.

I would STRONGLY suggest that you file a NPB first and do a FVF first. If you have read this board for a while you know that there are too many instances where the winner has come back to purchase and left negatives for the seller because the item was relisted to early. Cover yourself, wait the time and file

OK, thanks for the replies. I waited 7 days and then the 2nd highest bidder bought it and today I filed the NPB. In future, will wait the full 17 days. Seems like a real delay though. Just didn't want to go against ebay's rules

When a buyer received the NPB warning, it clearly states that the seller is no longer obligated to sell to that bidder.
You take the risk, no matter what!

I hate when someone buys with a Buy It Now, you respond immediately, and then no response for many days.

I mean they were RIGHT THERE at their computer.

If you use the BIN option, go to your listing, click edit, then scroll down to use Payment.
From there you can click the immediate pay button, thus eliminating BINers doing just that!
There is only ONE huge problem.
Vendio is not yet set up for relisting a BIN with immediate pay.
If the item doesn't sell, you have to relist it on Ebay.

NPB 7-10 days
FVF as soon as I can after NPB (10 days)
Relist after that

Too many people paying late to relist, I'd rather wait a week or two to relist and hope the buyer comes through.

I never send a payment overdue notice, that is what NPB is for.

I am confused by the answers on this thread. How much time do you give after the close of tha auction for payment? When do you file a NPB? I give 10 days from close for payment. After 7 days I send a reminder. On the 11th day I file a NPB. I wait 5 days & relist. On the 21st day I file for FVF refund. I don't have very many nonpayers, but have 2 this week.

Was it a Second Chance Offer?

Paloma is correct in saying that in many, many instances such a fast action will result in a negative feedback.

In my TOS I say payment must be received in 10 days. In my WBN ( say contact must be made in 3 days, contact meaning answering my email with name address and when they are going to pay. I am gong to start using the 3 day notice that eBay will send. You find that in your sold items. Then 7 days for NPB, the in 10 days FVF then relist. It seems like a long time we are giving the buyers. I think during this time and if you have many bidders on an item we should be able to send a second chance offer sooner. As a seller I am trying to sell my christmas merchandise and if I have to wait that length of time Christmas will be over. When I bid and win an auction I go directly to PayPal and Pay. In a perfect world that is the way it should be but since it isn't then the seller sits and waits.

Libra,
You can relist on the 7th day!
Why do you wait for 17 days?
Especially on Xmas items!

When you send buyers the NPB alert, day 7, at the earliest, it clearly states that the item may no longer be available, another words, relisted.
Sometimes I give the buyer an extra 24 hours after filing the NPB. If I hear nothing, I relist.
That releases your obligation unless you give your buyers more than 7 days to pay.

I only accept Paypal, so I expect payment no later than the 7th day or I do relist.

Yes ACE - it was a 2nd chance offer and sold it right away

to liveinjeans - in other auctions, I was waiting 7 days to file the NPB and then another 10 days for the FVF but being as it is Christmas, I only waited 7 days. Now is the time to get sell this stuff before Xmas

I think I did mine bass ackwards.

When I sent my end of auction notice, the guy that won an item, flat out said, he 'didn't have the funds, and was not going to buy it' wrote him back and said I'm filing an NPB alert... he didn't like that, but never heard back... I relisted a few days later, and then I filed for an NPB, running a 10 day auction on it, it ends in 2 days, if he pays, his money is refunded. End of story.

In this case, when a winning bidder flat out tells you they are not paying, IMO, relist it ASAP. But that is only IMO, and for this type of situation.
