I started a thread last week about a bidder I had to never paid and threatened to leave me negative feedback if I left her negative feedback. Well, I got another email from her today. The auction ended on May 9 and she still hasn't paid. SHe is now accusing me of feedback extortion. Here's a copy of my original email to her (her new one to follow):
Tomorrow will mark 10 days since auction close. My Terms of Service require contact within 3 days, payment within 10. I have had no contact with you since auction close despite numerous e-mails using both my e-mail system and eBay's. In one week I will be able to file with eBay to get my fees back and at that time, eBay will add a warning to your account. Three warnings and eBay will suspend your account. Once I file to get my fees back, I will post feedback accordingly.
Please safeguard your account and contact me before tomorrow. Once I re-list the item, we will not be able to resolve this matter amicably.
Now for hers from today:
To Cheryl,
My words are included below with my attached email. I did not threaten
negative
feedback, YOU DID. If you would actually read my email below, you would
see that
I wrote the following regarding feedback:
"It's not nice to threaten negative feedback -
You mention solving the matter "amicably"
after ignoring my emails, then sending these Ebay Threats,
then threatening negative feedback,
I will also post feedback accordingly."
I stated that I would post feedback accordingly. I have the right to leave
feedback regarding the way that you have treated me. I have just as much
right to post feedback as you do. You are the one making threats.
Feedback extortion involves threatening to post negative feedback if the
user does not do something that they are not obligated to do. I did not ask
you to do anything - I simply responded to your threatening emails.
I simply stated that I would post feedback accordingly.
I don't know what YOU read in my email - But I do know what you
mentioned in YOUR email.
See below an excerpt from Ebay's Feedback extortion help tips: (she goes on to paste the rest like I've never read it before)

What is she nuts? How did I commit feedback extortion? I think she's a total nut case. What's even worse is I filed the NPBA on the 16th, received the confirm email from eBay that the NPBA was filed and now when I went to get my fees back, it says I never filed the NPBA. I emailed customer support on the issue. I don't want to wait yet another 10 days, making it 20.
What is this "how you treated me?" bull crap? My email to her was factual and not threatening. She is the one who didn't pay.
Wake up eBay. I'm getting sick and tired of this crap. As soon as you manage to fix the FVF problem and I get my fees back, she's getting the biggest negative she's ever gotten. At this point, I could care less if she leaves one for me. Hopefully, she'll swear in it and they'll remove it. What a looney tune.

imho, THIS is the worst part of your whole situation! I am pretty sure this has happened to me a couple times too, but *I* didn't keep the confirmation email ... I was thinking that with the new 'my ebay' or even at Feedback Forum, it would be really great if ebay would make a designation as to what the date was that an NPB notice was filed ...

Thanks, Marcia. If anyone is committing feedback extortion it is the buyer. I hope she sent my email to eBay so that they can see what a nut she is. I had three non-paying bidders in a row and that's a lot since my sales have been very slow. She's a blocked bidder and now I'll have to block her from my email program.

I just went to check and she made her feedback profile "private" now. It wasn't private 10 minutes ago. Hmmm, wonder what she's up to. AND SHE JUST LEFT ME A NEG. WHAT A #*!@.

Thanks. Tell Raphie thanks for the howl. What really pizzes me off is that it appears she posted negative feedback in retaliation of me filing to get my fees back. Funny it happened right after I got my notice from eBay confirming that they were returning my fees. I hadn't left any feedback at all yet. I guess she didn't like that black mark. I wasn't going to leave her any feedback at all, but she forced my hand. She lied in her response to my feedback that I lied and that she did pay. HUH? I don't think so. I'm not going to eat the fees now in order to keep from getting a neg. Is that the new feedback game? File for your fees and the NPB will leave you a neg?
Anyway, by making her feedback private and considering that she cannot hide the fact that she has two recent negs, she did herself more harm than she ever did me.
