Hey All-
Well I can honestly say today was undoubedly my worst day ever as an avid Ebayer! I recently established a new Ebay account, after some person(s), tried sabotoging my Ebay business for nearly two months.
I once again resumed selling a particular item my competition continues to sell on Ebay reguarly. Obviously "He", found me, and reported the item I/We are both selling as a listing Violation. I reported him as well, however so far Ebay has done absoloutly nothing! He contines to sell this item on a regualar basis. My account is now suspended, and obviouly Ebay does infact do selective processing, if your a "Powerseller". My old account had a Feedback score well over 3,000,..the account which was suspended today is new with a Feedback score totaling 250, @100%
I have obvioulsy appealed the suspension, does any one have any other suggestions? Please I'm begging you guys, I have a morgatge payment to make...baby etc. Absoloutly Amazing you decide to run your entire business infrastructure though Ebay, and this is how your treated.

That's a tough one. I can give you sympathy but I don't know the answer. I suppose being suspended you can't get an email to ebay. Can you reactivate you old account? There has to be someone on this board that can help you. I wish you luck.

excelrye, don't try to sell under another account as that's a no no if you've been suspended and if ebay finds out you may never get back on. Not sure if you knew what you were doing was a violation and you took your chances but reporting the other seller isn't really going to help you now.
You will probably have to wait until ebay decides how long you are suspended for. I guess it doesn't hurt to apologize to them and plead to get back on.
Sorry this happened to you if it's your only income. I don't know what to suggest to help you...... is your product something that you can sell to local stores or outlets? Would you be able to set up at a flea market for awhile? Hopefully someone else has some ideas to help you. Good luck and I hope all works out for you.

That is really a BS way to do business. Where does it say that 2 sellers can;t sell the same product? Did you know that if there is no activity on your old acct for 60 days, you can merge accts. I am doing this after my original acct was being fraudently used by some one from Germany. I should have the merger completed in a week. I hope that you can get this resolved soon.

This is our sole source of Income, our livelihood etc. I have contacted Ebay, in relation to getting the suspension lifted, however I'm sure my efforts will be in vain.
Amazingly our competition continues to sell the exact same items we were suspended for, without any Action being taken on behalf of Ebay.
This is simply bad business, Ebay does infact do "Selective Processing", as this case clearly illustrates. Again if anyone has any suggestion I'm all ears.

excelrye, have you talked to them (ebay) on the phone yet? Or just email? If not do so, if so, try again. Ask to speak to someone in a position to make a decision on your sole livelyhood.
Heck, if your really desperate email meg. (What is it [email protected] or something?) Not really sure what it will get you if anything....
Meantime, why not try overstock or even IBID. It sounds like you need some money coming in. I read about some other sites getting some buzz. Lunar something or other? Few others. I will see what they were then post back here if you think its an option you want to try....

Is the item you were selling prohibited by Ebay, or was it a technical violation? Did you know you were violating Ebay rules, and have they warned you before?

Yes They warned me 4 times, and I reported my competition at least 10 times. However GUESS What he's till Flipping Selling on Ebay while I'm suspended for 30 days. What's up with the Hypocrisy..Please tell me. This is BS, maybe he has a relative who works for Ebay. Even more intresting I just checked my account....3 auctions are still running and I'm supposed to be NARU?

And then,,,,,,,,,,,,,,,BUY something from your competition and THEN turn them in for Bad contact info!!!!!!! hahahahaha.........there is a thread about that VERY thing right now, Does ebay Check? doubtful....do they NARU when told,,,,?? Give it a shot!

You still have not told us why you were suspended. Was it the item you are selling or a listing violation?
If eBay is your only income, why in the world would you ignore 4 warnings? I agree that it is not fair that the other guy is still selling but that is no excuse for you to keep violating eBay rules. Especially after you were warned 4 times.
I think you should try selling somewhere else for the next 30 days. Then when you come back follow the rules.

Have you thought about consulting an attorney. Inlight of the bad press that Ebay has been experiencing these past several weeks due to their price increase, I am sure that they would not want anymore bad publicity. They just had someone file a lawsuit the past few days over something, can't remember the details. Having a senior moment, I guess. I am not for running to an attorney everytime something goes wrong for me. But my 2 older brothers are attorneys so every family gathering, they are talking shop so you can't help but listen and learn.

The thing is, you don't need to worry about him or the fairness of the situation at this point. Granted, we all agree it's BS and you're getting selectively punished. But the fact remains, you should consider yourself very fortunate that you're only pulling a 30 day suspension after you've been warned 4 times. You need to realize, that if you repeat this violation one more time after your reinstatement, your next suspension may be permanent. Re-read the advice Replaymedia gave in his post above.

when you said you have 2 ebay accounts,do you mean you have 2 accounts each with different credit card and ID or are you talking about two seller id under one account??
so what happens to the first account,what is the status of your first account??
why dont you list an item your competitor is selling and some of us may be able to tell you why he is not suspended after you reported him TEN TIMES!!!!

You know this is a perfect example of why all of us should have more than ONE e bay account...e bay SAYS, they CAN'T be connected in ANY WAY, Shape or FORM if that's REALLY their rules, then even EBAY has NO idea who you are under a DIFFERENT ID.
Now,, MAYBE doing it AFTER the FACT,,,I dunno......

I agree it was obviously a stupid move on my part, and obviously I'm not a "Big Cat", yet. However when I'm completing 1000 successful transactions a month this kind of BS won't happen...I'll just give my Powerseller Rep a jingle which is obviouly what he did. Do you guys honestly think a "Powerseller Rep", has this much latitude?
Below is a copy of the wonderfull email I was sent on behalf of ebay

We regret to inform you that you have been suspended from eBay for a period of no
less than 30 days. Consequently, all of your current listings have been removed
from the Site regardless of whether or not they violate eBay policy. During this
period you will be unable to leave or receive feedback, bid on or sell items, or
file for an Unpaid Item credit. Should you need to access information from listings
which ended before your suspension period, you can do so by reviewing the notices
you received at the time the auctions ended.
You have been suspended for engaging in activity expressly prohibited on eBay's
Site after receiving prior warning to discontinue such activity, specifically:
violating our Weapons & Knives guidelines.
We have taken this action only after careful consideration of the history of violations
on your account. We have reviewed carefully each offense that led to this decision
and verified that the correct action was taken.
While this suspension is active, you are prohibited from registering under a new

The Suspension notice states I can't used my account "At All", what about fullfilling the 93 orders I need to ship out? Anyone have any suggestions? Like Ebay isn't freaking tough enough with NPB, Paypal Chargebacks, shipping problems..etc..etc...etc

You are joking right... You are not seriously asking us if by suspending your account ebay is also telling you that you should commit fraud by not shipping paid items are you?
Are people really THIS stupid?
Why would you continue to list something after your auctions are shut down not once, not twice, not even three times, but FOUR TIMES? How dense are you? So what if someone else is doing it too - that's the excuse a six year old offers when they get busted breaking the rules.
Sparkz is right. Consider yourself lucky that it's only 30 days. During that time you might consider dedicating some time to finding legit items to sell.

I never said I was going to defraud anyone of anything they purshaced from me prior to be suspended, or for that matter those rendering payment for item(s)post suspension.
And I guess you think it's perfectly "AOKAY", ethical on Ebays Behalf that they allow my competition to sell the exact same item(s) I was suspended for?

There are certain policies on listing items that are considered 0 tolerance. Endangered species, alcoholic beverages, and their policy on knives and weapons. Ebay wants to protect themselves, and you, from running affoul of any state or federal laws. No two states have exactly the same laws concerning knives, swords etc. There is probably something in your auction descriptions that makes yours illegal and his o.k. It could be one single word. I've had it happen to me. Four of us sellers had the exact same item listed, but my description had the word "badge" in it. That was enough to get it pulled and get me a warning. Perhaps he only ships to the U.S. and you offer to ship internationally? There could be any of a number of reasons. I once had an item pulled from the medical equipment category because I didn't use the exact wording in one paragraph of the description that ebay requires. I had to dig to find out exactly what I did wrong. If I were you, I'd run, not walk, over to Overstock and start listing those items before they get as heavy handed as Ebay, and find a new and safer line to sell on Ebay when you get reinstated.

Finally someone with some solid advice... thanks. I think you hit the nail write on the head.
I shipped this item internationaly, he didn't....however why wouldn't Ebay inform me of this? I even emailed Ebay 5 times in relation to why I couldn't sell this and he could no reply after 6 days? One more Quuestion is Overstock, Yahoo, Amazon.. that profitable?
