But, but, but as e bay states "You have entered into a LEGALLY Binding contract". How can he say he REFUSES to PAY

Oh! Now I remember, people are BASICALLY Good....however for those who are NOT e bay STILL keeps MONEY whether YOU get paid or NOT.

It says that because it's basically true in most instances. If it reaches the point where an unpaid item dispute has to be filed, it's because the seller didn't get paid by the buyer. IOW, he refused to pay, regardless of whatever lame excuse or line of BS he comes up with. He's a deadbeat, so cut through the chaffe and tell it like it is. Buyer refuses to pay. You won't be holding him up to public ridicule. Only the buyer, seller and Ebay will ever see that statement.
