I have a problem and need some advice. My son bought a car last year (june 2001) the people he bought it from said they would have the title for him within 3 days. He still has not got the title, I have tried everything I can think of to help him. We trusted the people to get this to him, The last time I called about it I was told never to call back again that it was not there place to get the title it was up to us. (the man who owned the car is a State Trooper) We have a car sitting in our yard and cannot get a tag or Ins on it. Any ideas on how I can help my son get a title.

A year later and no title? Did you take a loan? If so the lender must have a lien on the title. Have you checked with them? The Department of Motor Vehicles in your state has regulations regarding issuance of titles by dealers. Have you not checked with them?

Car was fully paid for at the time it was bought. We have the bill of sale ,but with out the title cannot get the tags . I have contacted the lic dept and I cannot do anything until he gets us the title., Its crazy. I cannot find a lawyer who will touch it , the court house is no help. We were told to scrap it out ( this car was a fixer upper it is a old Cougar) My son has already put alot of work into the car.

Forgot to mention, The court house title section to me that I could get a Surety Bond and get the title that way. Not sure how this works , I have been trying to find out info on it also.

As you have found out, without a title, the car is worthless because you cannot get tags or insurance. Your only hope is to get in touch with the seller and hope that he cooperates with you. If the seller has lost the title, he can get a copy.

This is Maryland's policy...

Look at this site:

http://vintagecars.about.com/library/weekly/aa011301a.htm

http://www.leetc.com/transferofcasualtitles.htm

These may or may not help but give you some ideas.

Also go to www.google.com and just type in "Lost Car Titles" will give you other information.

Did you get the car from a dealership? They have a legal obligation to provide a valid title. If so, take them to small claims court for the value of the vehicle since it useless to you.

Good luck getting the title.

Then, in the state of Maryland, before you can get permanent tags, the car must pass inspection. Costly repairs on an older car may be necessary before an older car will pass.

Ask the license bureau how to get a title for a "junk" car that your son restored. Some states have a special title for cars put together from junk.

Yes At DMV in any state you will find a form to fill out For cars that were Junked and have no valid registration or tiles any longer.

I don't know what the form number is but we have registered a few cars this way How ever this you will also need a signed sworn statment from the last owner Junk yard or who ever,as well as the bill of sales as well a registration half signed junked on the back helps but is not nessary if all your other paper work is in order..

All this may or many not beable to happen in a day as all the papers and signatures must be stamped, witnessed and notarized ..

O.K. THE LAST OWNER,,,,,AND A HIGHWAY PATROLMAN AT THAT! WILL NOT GIVE YOU THE TITLE? (SUCH UP HOLDERS UP THE LAW HE SEEMS TO BE, MIGHT WANNA CHECK WITH HIS STATION COMMANDER IF YOU ARE IN HIS AREA. HE MAY HAVE A FEW CHOICE WORDS FOR THIS "LAWMAN".)

IF NOT AND REALLY WHY BOTHER. DON'T! JUST A THOUGHT. MAYBE AFTER YOU DO THE FOLLOWING HOWEVER. JUST TO GET HIS CAGE RATTLED.

GO TO THE DMV GET A LOST TITLE FORM. LEAVE THE DMV. FILL IT OUT. GET ANY BUM ON THE STREET TO SIGN IT. GIVE E'M FIVE BUCKS. THERE IS NO VERIFICATION OF SIGNATURE. AND THE COP, UNLESS,,,,,,,,IT'S STOLEN COULD CARE LESS AND IF IT IS,,,,,,WHOAAAAAA,,IS HE IN A WORLD OF YOU KNOW WHAT!

TAKE IT BACK TO THE DMV A FEW DAYS LATER. TRY NOT TO GET THE SAME CLERK YOU CRIED THE BLUES TO,,,,,MATTER OF FACT GO TO A COMPLETELY DIFFERENT DMV OFFICE WHERE YOU HAVE NEVER BEEN. JUST PRESENT THE FORM AND THEY WILL ISSUE A NEW TITLE IN YOUR NAME.

IF THE CAR TRULY HAS NO LIEN HOLDERS ON IT NO ONE WILL CARE THE LESS. WHY THIS COP WON'T SIGN THE DUMB FORM LEAVES THE DOOR OPEN.

I ON THE OTHER HAND HAD THE EXACT SAME EXPERIENCE WITH A GOOD WILL STORE SALE OF A VEHICLE. NO PINK,,,,LIES. WEEK AFTER WEEK. THEY WERE GETTING THE PINK A.M. I FINALLY CALLED THE OWNER WHO SAID GOOD WILL COULD GO TO HELL AND ME TOO. WHAT EVER PROBLEM HE HAD WITH THE GOOD WILL WAS NONE OF MY CONCERN. I WANTED THE PINK. THE GUY HUNG UP ON ME.

I HAPPEN TO HAVE A LAW ENFORCEMENT FREIND WHO TOLD ME EXACTLY TO DO JUST WHAT I TOLD YOU. GOOD LUCK.

TWO YEARS LATER I SOLD THE CAR AND HAVE HAD NO PROBLEMS WHATSOEVER. THAT WAS TWO YEARS AGO.

THERE IS AN EX DMV INVESTIGATOR ON THESE BOARDS WHO MAY SEE THIS AND OFFER HIS ADVICE.

EDITED TO ADD,,,THIS WILL NEVER HAPPEN AGAIN AS I WOULD NEVER BUY A CAR WITHOUT SEEING THE PINK SLIP RIGHT THEN AND THERE! THE GOOD WILL PROVED TO BE AS BIG OF A CROOK AS ANY INDIVIDUAL..... THEY LIED TO ME AND SAID THE PINK WAS COMING MORE THAN 20 TRIPS TO LONG BEACH AND NUMEROUS CALLS TO THEIR "DMV" PERSON ON STAFF. WHAT A CROCK! SEE THE SLIP OR LEAVE IT.
[ edited by JACKSWEBB on Sep 21, 2002 07:50 PM ]EDITED TO ADD.

ANYONE ON E BAY WHO BIDS ON A CAR WHO DOES NOT ASK THE SELLER A QUESTION AND GET A PINK FAXD TO THEM IS LOOKING FOR A NIGHTMARE. STATES AND MILES APART....

In most states it is against the law to sell a car without a clear title. I would take them to court and get my money back. My Dad bought a car in the state of Florida and the guy never gave him the title. My dad took him to court and got his money back. I have seen that done many times in that state.

Indeed, I'm surprised it took this long for someone to suggest a lawsuit. Go to small claims court and sue for the amount of money, plus any upgrades (hope you kept receipts) your son has put into the car. Then arrange (since you have the address of the "cop" to have him served. You will both show up in court and tell your sides and the judge will either award you a refund or tell the cop to cooperate (assuming the story is as you say).

Not my name on ebay.

ARE THE BUYER AND THE SELLER EVEN IN THE SAME STATE? I DOUBT IT. LAWSUIT, WHAT A WASTE OF TIME AND ENERGY. EVEN THE MONEY HUNGRY ATTORNIES SAID HAVE A NICE DAY ALREADY.

IT'S A SIMPLE CASE OF "LOST" TITLE. EASY FIX. GET A DUPLICATE TITLE FORM FROM THE DMV. AND MAIL IT TO THE COP! TELL HIM TO SIGN IT AND SEND IT BACK. DO IT REGISTERED MAIL AND ALL THAT LEGAL STUFF. IF HE DON'T,,,,,HE MAY WEAR A BADGE BUT THAT DON'T MAKE HIM A COP. ACTUALLY, HOW DO YOU KNOW HE IS A POLICE OFFICER? HE IS HIDDING SOMETHING AND MUST BE A FOOL ON TOP OF IT. ASSUMING AS VALLEYGIRL SAYS THESE ARE THE FACTS.

THIS POSTER HAS NO CHECKED IN LATELY,,,I GET THE FEELING I AM TALKING TO MYSELF,,,,AGAIN!

The owner of the car is a Alabama State Trooper. The only thing I have not done yet is contact the office he works out of , Dept of motor vehicle says I can get a bond to get the title, but it will cost 1 1/2 times book value.

In this state (WA) its just a matter of filing for Lost Title, (it may take 6 weeks or more) and it comes out of Olympia (state capital) And I don't believe you need the last owners signature or anything. I know we have done it, but it was long ago.

A state trooper? thats pretty bad!

Good luck!

Hi, and thanks for the info. I still have not gotten the title, I have been thinking about calling the trooper office and leaving a message for the guy hopeing he will get back in touch with me. The bond the court house told me about for the title will cost 1 1/2 times the blue book value of the car ( its not worth that) the only other option will be to pull the motor & trans and sell those ( these are great low mileage ) and try to junk the body.
