LOS ANGELES -- A Filipino couple is suing the United States government, alleging the man was denied permanent U.S. residency because his wife is a transsexual.

Experts said it may be the first legal challenge of its kind.

Donita Ganzon was granted citizenship in 1987 -- six years after her sex change operation. She was given a certificate that listed her sex as female.

Her husband, Jiffy Javenella, applied for permanent resident status after the couple married in 2001.

The lawsuit alleges Javenella's application was turned down earlier this year -- within three weeks after Ganzon revealed she'd undergone a male-to-female sex change operation. Javenella now faces deportation.

A government memo cites the 1996 Defense of Marriage Act, which defined marriage as between a man and a woman, to support its position.

Since when is American citizenship GUARANTEED to immigrants? It ISN'T their birthright.

Citizenship is not guaranteed, but if you look at the reason why the government denied the citizenship you will see it doesn't make sense. The government denied it on the basis of the DOMA - the couple is one man and one woman (now at least).

I hope a cop uses that logic the next time he gives you a ticket. It doesn't matter why you got the ticket, you just got one.

Bear liperals will never understand and homosexuals are just trying to swallow that sh!t sandwich they made for themselves...

It is too much for thier limited minds to understand that the people of the US did not/do not want homosexual marriage.

Twelve - this is not a homosexual marriage. His wife is legally, phsycally, and emotionally a woman.

LAS VEGAS -- The five-year marriage of a former Marine and a Bahraini royal whose story was told in the made-for-television movie "The Princess and the Marine" is over.

"It was what she wanted," Jason Johnson told the Las Vegas Review-Journal of the divorce he and Meriam Al-Khalifa filed for Nov. 17, the day after their fifth wedding anniversary. The divorce filing calls them "incompatible in marriage."

Johnson, who had tried to sneak the princess into the United States and was demoted in rank over forging a Marine ID for his beloved, , cast the tale as a "Romeo and Juliet" love affair that disintegrated amid Las Vegas nightlife, opposition by his wife's family and at least one death threat.

Al-Khalifa was not represented by a lawyer in the divorce filing. No one answered her apartment door Monday and it was unclear whether she planned to stay in the United States.

The story started in January 1999 when Johnson was stationed in Bahrain. Al-Khalifa is one of five daughters of Sheik Abdullah bin Ibrahim Al-Khalifa, a distant relative of Bahrain's king, Sheik Hamad bin Isa al-Khalifa.

They met at a mall and fell in love, though he was a Mormon and she a Muslim, forbidden to marry a non-Muslim.

Her family ordered an end to the romance. They continued to secretly exchange letters through a mall employee.

Johnson spirited Al-Khalifa to the United States when his tour of duty ended in November 1999, using forged documents and a disguise.

Al-Khalifa sought political asylum in the United States and the couple married in Las Vegas in 1999. He was 23. She was 19.

The story made headlines. Besides the TV movie, the couple made the rounds of television talk shows. They rented an apartment in Las Vegas and lived off money from the movie. Johnson got a job as a parking valet on the Vegas Strip.

He described constant tension with Al-Khalifa's family, and said the FBI once told him they intercepted a man who said he had been paid $500,000 to assassinate her.

Johnson said Al-Khalifa plunged into Las Vegas nightlife, partying with friends and ignoring him.

About a year ago, Johnson said, Al-Khalifa left him. He now lives in Las Vegas with his stepmother.

"Deep down inside, she knows that I loved her more than anything in the world," he said. "I can say I enjoyed every minute I spent with her."
