Story:
Today I went swimming at our college pool. I managed to cut my foot on the metal pool drain and filled out an accident report with the lifeguard and department head while they bandaged me up.
I then drove myself to the local Urgent Care, where SEVEN STITCHES and $368 I'm all sewn up and limping around the house.
It was after office hours by the time I left the Urgent Care center, so I haven't contacted the school yet beyond the original accident report and first aid.
I really don't want to have to involve the courts, but this WAS their fault, and $368 is money I can't afford to blow right now. They MAY step right up and offer to pay my expenses, but it wouldn't surprise me if they weren't required to fight all claims.
Anyone here ever run into a similar situation? Anyone have any suggestions on how to handle this tomorrow morning? I'm not generally a threatening or argumentative person, and this pending debate has me more nervous than this throbbing foot.

You might when you give them a call, mention something about OSHA. I would hope your wouldnt have to worry as they should have some provision for that kind of thing.

Well being the fact that metal pool drains are usually at the bottom of the deep end of the pool which is usually 10-12 feet below the surface,I cant say that I have.I usually dont hang out down there,unless Im trying to drown myself.

Unfortunately, that's my favorite spot. I'm the one guy out there who LIKES to dive for the 10lb. rubber brick! Although my brick-diving days may now be over ;(
If they actually DO pay my bill, I probably won't be real welcome there anymore.
If they DON'T pay my bill, I'll be too P.O.'ed to go back.
After the show I put on today and the audience it attracted, I'll probably be too embarassed to go back anyway All for a couple cuts and some pretty squirting blood. I wonder how many spectators I could have attracted had I actually drowned or something?
I think I need a couple more aspirins now...

replay - OUCH, ouch, ouch. Sorry to hear about your injury. I'd bet the college has a office that handles the injury claims for things like this. Call the administration office and ask them who handles injury claims. I'd bet all colleges and universities have some type of 'accident insurance' for their students.
My advice...don't worry about things that haven't happened yet...ie: your claim being denied. And should it be/when it is...I'd call a local attorney and see what they'd advise. Usually they don't charge for a short consultation.

Linda-may I assume that remark was for the" I love you in 22 languages post"?? LOL
I do have a question-how did you cut your foot on the drain,and why do you think its their fault? Be realistic-people usually dont walk around the bottom of a pool 10-12 feet below the surface.

classic No, you may not. I found your line funny and so I was joking around. Had nothing to do with insulting all the people who live in the south.
If anyone posted anything like that about Mexican's or blacks or etc.....the left here would be SCREAMING from the rooftops. But when it comes to states that don't support their party...then they're ignorant. I think statements like that are sad because people in the south aren't stupid.

I tossed the brick down there, as I have done hundreds of times before in the past year. This time it landed on the drain. I dove down for the brick grabbed it, and pushed off the bottom... SLICE!
The drain is metal, and apparently has some VERY sharp edges. Like stepping on a knife- If you step on the blade as it lies flat on the ground, no problem. But then give your foot a little twist and see what happens.
No, I wouldn't think too many people walk around down there, either and I'd have never thought it dangerous either (obviously). But clearly it WAS dangerous, and I WAS down there.
Maybe the next person it happened to would have paniced or something? I'v got a chopped up foot, pain, stitches and a medical bill, but it COULD have been worse...
Actually, I'm a diabetic, too. Foot injuries are a big deal, as they CAN get a lot worse.

My wife was injured at a Motel Six swimming pool. It required a trip to an ER. Our health insurance covered it. Motel Six settled with us out of court for $600.00. As we were on vacation and in a different state it was the easier way to go.
If all you are looking for is your money out of pocket I'm sure their insurance will cover it as anyone who operates pool open to public use carries insurance.

You'll probably have better results since it's a college than I did with a public middle school! The desk my daughter was sitting in collapsed causing her mouth to go into the desk part. She lost three front teeth and had her chin and lip stitched up. It was pretty serious. They wouldn't pay the expenses and when I got an attorney, the school laid blame on my daughter saying she made it collapse. Unfortunately, the class she was in was one for "at risk" kids so they had a way to make her look bad. The attorney said after that that he wouldn't take the case. It could damage my daughter more and chances were good that the school would win just because they're a school. I ended up pulling her from that school and moving to another district. No, this wasn't Cleveland. It was a rather well to do suburb. She still has serious trouble with her teeth and her jaw.
