Hi Damon,

I sent $1800.00 to the Seller below for an HP 6000 Omnibook laptop and have not received the item. I paid this by Instant Transfer (checking withdrawal) via PayPal. I had planned on using my verified credit card, but your "default" payment always goes to "Instant Transfer (checking withdrawal)" and you do NOT allow the PayPal User to set a default to pay only by his/her credit card. I know PayPal maximized profits by doing this. Below is the Seller's response to the "First Seller Warning" she sent. I am hoping you can give me advice on where to go from here.

As you can see, she is admitting that she is at fault and is willing to TRY to pay me back. To date I have not received a commitment from her to do this. You have put a "reversal" on her account and it is apparently closed? Can I do any kind of a "chargeback" through my bank, even though I used "Instant Transfer"? Does PayPal aide a Buyer in recovering moneys when the buyer ADMITS FAULT?

I read PayPal's User Agreement and it states:
PayPal will seek to recover the funds from you by debiting your PayPal balance and, if there are not sufficient funds in your PayPal balance, PayPal RESERVES THE RIGHT to collect your debt to PayPal by any other legal means.

Does this mean PayPal may take legal recourse? If so, what type of action?

I'm not sure where to begin.

I sold the laptop in good faith to Dewey Fischer. I was selling it for a
friend that had won it at a trade show. I had first listed it on ebay and
the person who bought it never did pay so when Dewey asked me if I have
anymore I still had this one so I sold it to him.

Shortly after I sold it to Dewey I was in car wreck and broke my leg and had
head trauma and was unable to work for over three weeks. In that time the
person I gave the money to for the laptop had not only taken the money but
also sold the laptop to someone else. I had never sold anything for anyone
before except for my family and this has turned into a huge mess selling for
what I thought was a friend.

I would be happy and I'm also obligated to pay Dewey back his money only I
don't have it at this time. Do to fact that I've been out of work now for
quite awhile and having trouble just keeping my utilities on.

I apolize for this trouble and burden I have placed on Dewey and I'm hoping
you (paypal) can advise me on what to do. I can pay you back buy selling on
ebay to pay back my negative balance in my account on paypal. Will that
work?

Please inform me of what the best action to take here. I hope that my past
record show that I do have honor I will pay this back.

Hi,

I forwarded the information off to see if there is anything we can do. It does appear, however, that the seller is trying to pay you back because of their mistake. I still have to advise that our Buyer Complaint Process does not guarantee recovery of money from a party found to be at fault.

Can you give me a list of organizations that I can report this to as I do not anticipate a recovery?

You might be wise to go to your bank and talk with someone about filing an Improper ACH Debit Activity affadavit. It might or might not work in your situation. I my case I was able to reverse three fraudulant transactions. This form has a limit of 60 days, so hurry to your bank. Gook luck
