Can someone please help or give advice

I sent money to a Verified Seller on August 1 for $27.50 for a DVD (National Lampoons' Animal House)

After I had sent the money, he wrote back to me telling me he now does not accept paypal , even after he had sent me an email giving me a link on exactly where to pay him and saying he was a Verified Seller.

He then wrote a message to me saying that he have negative amounts on his Paypal account and hence did not receive anything , and thus wouldn't send me the DVD. He told to dispute the charges on the Credit Card.

I wrote to Paypal straight away (Within a few hours of payment) on August 2 and many times since then but havn't received anything except receipts.

Could someone Please give me some advice , couldn't Paypal force transfer from his account to my one , and he also said he would write to Paypal ?

Any Help / Advice very much appreciated

Contact your credit card company immediately and try to begin a charge back.

I agree with vvalhalla, you have very little time left to recoup the money that you sent. Immediately begin a charge back with your credit card company and do it in writing.

And if you did not use credit card funds but paypal funds then write to [email protected] to get this kind of crap taken care of which should have been taken care of all along.

Failing that, it is a trip to the BBB which is posted all over the place since PayPal took the payment on his behalf.

Thank you everyone for the replies , I received more responses here in a few hours than in the entire time since the transaction finished, Thank you very much !

I have only received receipts in reply to any questions and all of them saying to wait 30 days to allow investigation , but the seller even said he would write ASAP (assuming he is now being honest)

But I mean regardless shouldn't at at the end of the 30 days something be done regardless? I wrote to Paypal instantly which was really only a matter of hours from when the transaction finished. Ever since then , all I have received are receipts even from enquiries. I followed through and have waited like they said , now I'm worried they might not do anything since it's 60 days, but only because they said to "Wait" !

I'm going to try what you all said ASAP and will keep you posted.

Paypal Damon if you are reading this , please help

Absolutely , I filed instantly when I recieved his email and only within a few hours of the transaction finishing. (August 1) I can forward you all relevant emails between myself and seller if you like also; I have been waiting for a response since that date, and written at least 3 times since the 30 days expired.

He is also a Verified Seller and sent me an email straight away telling me where to go and pay after the auction

I will be happy to forward to you all information

I have to believe that email was sent straight away by paypal in behalf of the seller that had a negative balance. When paypal freezes an account the person that has the frozen account can't get in to disable the automatic end of auction email. I think that it's unethical to send email for a seller that has a frozen & negative balance account.
Have you contacted your credit card issuer yet?

UPDATE

I have recieved the email from Damon , and it tells me that they will not retrieve it his account as his balance is $0.

This is obviously nothing more than a scam.
I wrote to them within hours of the initial transaction , (Not to mention at least 5 emails , I counted) and now after leaving me hanging for 60 days they tell me this.

This is nothing short of a joke.

They are a disgrace and a scam.

What options does one have know after being held for more than 60 days . This is total rubbish.

I am sorry for the delay you had in response, but our records indicate that the notification was sent on Sept.9,2001(I do have to remind users that the Buyer Complaint process does not guarantee recovery of funds from another party, as these items are often listed at another venue).


My apologies for the issues you have had getting the response, as well as for the problems you have had with the seller.

Rubbish Damon. I have every email recieved and sent from every party. That is total rubbish, are you not listening to what I am saying. I sent you multiple emails , and I have the dates and letters to prove it. You did not respond to me , depite these letters being sent almost begging for a response.

So the story is like this , money has been deducted from my account despite my disapproval. I have sent you multiple emails and waited 2 months for a reply at terrible inconvenience

If we cannot work this out , we will begin legal proceedings in order to recover funds as would any business.

I am only reporting what I heard back on the case.

Our Buyer Complaint Process was resolved on the 11th of September. I don't know why the notification wasn't received advising of the outcome, but there very well could have been technical issues receiving the email (on our end or your end).

I am including a copy of the Buyer Complaint Process here to advise why we weren't able to recover, which is covered in our terms of use.

What is the Buyer Complaint Process?

PayPal's Buyer Complaint Process helps protect PayPal members when a merchant does not deliver goods as promised. If you have been unable to resolve a dispute with a seller, you may file a Buyer Complaint Form (go to the Security Center link in the footer of any PayPal page) to initiate an investigation. PayPal will investigate your complaint and attempt to recover any funds you are owed. You will be entitled to the return of any funds PayPal is able to collect on your behalf. However, fund recovery is not guaranteed.

Additionally, buyers who qualify for eBay's insurance policy (currently limited to $200) may recover up to an additional $200 of protection from PayPal if their purchase was made from a verified PayPal seller.

Kimba7000, what you are describing is something we have all heard here quite a bit (unless you are Roofguy, who exists in a parallel dimension).

The most important question is: did you send the money from your PayPal account or via credit card?

If it was via credit card, contact your card issuer immediately and dispute the charge.

If you sent it from PayPal funds, PayPal's protection is very unsatisfactory. They give themselves an umlimited amount of time to investigate and do not guarantee to recover your funds.

You have far stronger protection when you use a credit card under the Fair Credit Billing Act. Never send PayPal funds directly from your account!

Further, it's been reported PayPal continues to accept funds even when a seller's account is restricted. This obvious contradiction speaks for itself. For whatever reason the seller is no longer a member, PayPal let you send your payment. And now it's gone.

IMHO, some of PayPal's practices are very questionable. And if you read their IPO document, you'll find PayPal has had its practices scrutinized by no less than Visa, MasterCard, New York and California.

Like Caesar said , Buyer Beware. You would think Paypal with it's big reputation and everything would endeavour to protect it's
customers , and at the very least , reply to any correspondance.

Now I'm told the matter WAS decided , and it was sent a few weeks ago. How Convinient .. They will truly say anything and everything to get problems off their hands .. except solving the damn thing


****** Case Update ******

Tuesday 27th November 2001


Hi Everyone

I just thought I would update this message board to let you know what was the outcome.

My Credit Card company told me that it was covered under their insurance scheme in my account so I have FINALLY recieved my USD $27.50 back. Considering I made the payment on 1 August , its' been almost 4 months and a lot of headache but the CC has given it back to me.

As horrible as this sounds I'm glad it happened. I'm now more wary on the Internet, and plus this payment for a DVD was a kind of a test for me , if this went well (It was only our First Paypal purchase) than for our business which is expanding online I could use a service which is reliable and has excellent service.

Sadly their service was shocking so much that I couldn't even contact them despite many many MANY emails and their replies were so LAME that if any of us were running a business that way we'd surely go broke ..

In any case I have my money back , and I know Paypal is not the 1 to use !

While it was the money , in many ways it was more the principal than anything. If they cannot be trusted to give adequate support on a measly $27.50 payment , what chance in hell have they got when the payment involves amounts much much greater ??? So it kind of worked out well for me in that regard, I now know they are not the service to use !

I would say there's an angel looking out for me somewhere , because luckily this happened the FIRST time rather than at a time when my business would have started relying on it as a much much greater amount !!

I am truly grateful for everyones' suggestions', I was not aware of Auctionwatch or any other form of support until I hunted Auctionwatch down, and it was not until I posted on these forums that I got a reply ! So I GREATLY recommend Auctionwatch for this , and an even GREATER THANK YOU to everyone who helped me out and gave me advice !!

Thank you very much to everyone who helped (EXCEPT PAYPAL of course)
