I certainly wouldnt have the nerve to neg the guy after giving you everything you wanted in the end. I would understand if you had to fight for your refund but it doesnt sound like you did. IMO, you should have not left any feedback.

I'd be inclined to give the seller a positive. While I question some of his practices, his willingness to make a full refund is indicative that he accepts full responsibility. Not all sellers do and certainly not all do it consistently when they do. If he deals in more conventional and legitimate merchandise, I could overlook the fact that he missed the mark on this.

I really won't get into the shipping thing. That's a judgement call and I'm a buyer, nmopt his consultant or accountant. I look at shipping + product = price. If the price is fair, then I'm happy.

The seller does have Buyer pays actual shipping charges marked instead of see item description, so that can be a bit misleading...

A positive. You were not happy, he refunded all your money and let you keep the CDs. What more would you ask of customer service from a seller?

And they did! I feel that both parties are in the wrong!

I didn't mean to imply that you are trolling message boards.

You just seem a tad upset with anyone here that doesn't agree with you and if they start looking at other sides to the issue.

The feedback you left was totally undeserved IMHO.
My policy on only leaving feedback once it has been left for me is for people just like you.
You have no idea if the CD breaks any copy write laws, you said so yourself

I've not found anything definite that says they are or are not."

And as far as the Postage is concerned, the amount was stated in the auction. If you wanted to verify what you THOUGHT you were going to get, and how it was going to be delivered, you should have emailed the seller BEFORE you bid, not whined about it afterwards.

The seller did everything he should have done and more. You got the item you bid on for free and still left this person negative feedback???????

Please add me to the list of sellers who would like to add you to my "Blocked Bidders" list.

I think it's pretty clear that too many AW posters are more interested in playing retaliation-feedback games than they are in making successful trades on eBay.

eBay should revise the feedback system indeed. It seems to bring out the worst in some people.

Well since you are so worried about this CD the correct thing to do is Send it back even if it was not requested. You seem to want to stand on pretty high moral ground but I am not sure if it is high enough to send back the item. Could be a case of having you cake and eating it to. I am not in total disagrement with you (however I would not have neged) but keeping the CD now is pretty hypocritical even if you were told to. Just IMO so feel free to blast away

So he was one of the "Silly" seller's (Yep, I'm one of those silly sellers) who already gave you a positive, and NOW you are Thinking about giving him a Neutral (after contemplating a Negative) after he completely refunded the Transaction because you were unhappy. WOOOOW ,Now I see why sellers cannot handle some Buyers. it appears he DID overcharge you for Shipping, and did "Maybe" misrepresent the Item, BUT, and THIS IS IMPORTANT, he completely refunded the Transaction. Get Over it.

There was no sale, in the end he gave you a gift and you still left him negative feedback.

Looking at the sellers response to your feedback, I can tell he is as dismayed as I am.

I looked at the auction. You supplied enough information in your posts here to make it very easy to find.

The sellers response was "I gave the guy an immediate refund via paypal and let him keep merchandise."

And you still had to add another comment after his response???

Oh and don't worry, I have no intention of posting your ebay ID here.

peiklk, i understand what you are thinking but i have to ask "WHO DIED AND MADE YOU THE EBAY POLICE CHIEF?"

if you were going to turn him in anyway and give a neg, you shouldn't have had the gall to ask for a refund. it is buyers like you that drive us all crazy.

ask the questions before you buy, anyone knows it doesn't cost $4.00 to ship a cd, so what did you think it meant?

So are you keeping the CD or since you are "unsure if you can listen to it" are you doing the correct thing and sending back ? The answer to that one will clear up a lot of things Regardless of what the seller said to do with it it should be sent back and you already stated that it is a minimal .80 cost so it shouldn't hurt you to do "the right thing" espcially since you have a complete refund.

I think shipping is the only thing at issue.Public domain is permissible -copied copyrighted material is illegal to buy sell or have in your possession.
On the Postage: The seller listed 4.00 in the listing and thats what you paid, dosnt matter if it said shipping and handling or just postage . Its pretty much universally understood that the charge listed is what your giving the seller regardless of what the stamped postage on the envelope says.This seller did an extraordinary thing in refunding your purchase price and allowing you to keep his merchandise. Unfortunately you did a great disservice to him by leaving a negative for his trouble and reporting him for a possible copyrite violation which you arent sure of.

This may backfire on you as the seller may use a FB follow up comment to warn others about your wrath. Its always nice to be nice.

I'd have to agree with some of the other here. I think you went over board. I have indeed placed you on my bidder block list. No hard feelings but you have created a huge headache over pretty much a non issue that works both ways.Seller worked with you and insured a complete refund without the product. Odds are small you would ever bid on an item of mine but I have reduced that chace to zero now. I charge a flat $3.00 to mail most of my stuff and sometimes it cost a little less than that (sometimes more) so I would had to get a neg or in to a pi@@ing contest over a dollar. Lots of luck in the future.
