I think the overwhelming consensus here is that it was wrong, but the buyer thinks he is in the right, I don't think he has reevaluated his position. Good thing I don't have to worry about him running into one of my auctions though, I feel sorry for other sellers out there who might deal with him.

The frustrating thing is that for those that saw my information on ebay, they can see that I'm not a problem buyer. But for some reason people think that one disagreement -- where I still think I have a valid claim (and they do to) -- makes be a problem buyer. My record shows otherwise.

True, I'd probably never run into their auctions anyway, but the principle of the thing is what gets me. What this seller did is not something that the majority of sellers here do (myself included), yet they are acting like he's just an everyday seller who did absolutely nothing wrong. And because he got caught and refunded my money, then all is ok.

When a person shoplifts from a store (and the jury is still out whether this guy is selling illegal merchandise) and gets caught -- they aren't given a choice of returning the goods OR being prosecuted. Usually both happen. In this case, he gave me my money back, but is still being held accountable for what was done in the first place. What he did may or may not be wrong, but at present all indications point that way. Even if not illegal, it does seem to violate ebay rules.

Silly me decided to mention the lesser offense of his misrepresenting postage costs and getting into the inevitable debate -- most comments that people made are comments I make all the time (about agreeing before the auction). The real problem got lost in this postage vs. shipping nonsense.

Oh well, thanks again for all your comments, pro and con. I go away from this topic having learned a great deal. I hate that some of you have drawn grossly errant conclusions about my conduct as a seller or buyer based on this ONE isolated example, but that is your choice. Thanks to those who found out my real userid and have kept it off these boards. I do appreicate your professionalism in this regard.
