Interesting.

I did the Search using "windows xp"
Came up with someone selling a disk just like mine.

Then I did a search on my old email and found this seller had bought a disk from me May-03-02.

Now I have the email addy of this seller.
I then did a search on Google using the email addy and found a a website with the sellers contact info...the first name is Peter.

I pulled the contact info of the bidder that messed with me and the first name is also Peter. And they live in the same town...

Conicidence?????

Hello,

Thank you for writing to eBay. I am sorry to hear about this situation
with the unwelcome buyer, skiracr2. I understand your frustration and
concern over the issue.

We are concerned about violations on the site and have thoroughly
investigated your report. Please be assured that we have taken
appropriate action in accordance with our site policies. Our actions may
include issuing a warning, temporary suspension, indefinite suspension
or terminating the membership.

As you may know, we are unable to provide specific information regarding
the result of our investigation to third party members. Please
understand that this is for the protection of all eBay users. However,
we can tell you that our records indicate the user you are reporting is
currently not a registered eBay user.

I have forwarded your request for the feedback removal to the
appropriate department, and they will reply back to you shortly.

You may relist the item and request a credit for the Final Value Fee.
Our system will then keep records of the credit requests that are
received from sellers regarding transactions that were not completed.

To request a Final Value Fee credit, please follow the steps below:

1. Click the "site map" link at the top of any eBay page.
2. On the "Site Map" page, click the link "Request final value fee
credit" under the "Seller Accounts" heading in the middle column.

For more information on how to request a credit, I encourage you to view
our Frequently Asked Questions page below:

http://pages.ebay.com/help/sell/bidders_overview.html

I understand your frustration regarding this matter and apologize for
any inconvenience it might have caused you.

Beware! Protect yourself from fraudulent emails that ask for sensitive
personal information like credit card numbers, passwords, etc. Just
because an email message looks like it is sent directly from eBay, it
isn't always. To learn more about protecting yourself from fake or
"spoof" emails, visit our User Account Protection page. Simply cut and
paste this Web address into your browser window: http://member.ebay.com/ad/ck/1065-11789-3840-13

You will probably have to wait the 7 days after the auction ended. When you file the NPB notice, you will be prompted to file for FVF at the same time if he is NARU. There is no 10 day wait.

After you file for FVF, figure up all your listing and featured fees and send Peter a bill. If he doesn't pay, turn it over to a collection agency. You may not collect, but you can play hell with his credit report.

From live help tonight"

Yeah the Safeharbor department has tools that they can use to link the two accounts together and then take action against them for you. If someone has one suspended account, then it is actually against our policy for them to access eBay with another account, and so if these accounts are both from the same person, SafeHarbor can prove it and then take action against their active account for you.

Sounds good in theory but I seriously doubt that any collection agency would touch the case with a ten foot pole.

I emailed them saying I did not think I should have to go through all the hoops to get credit and very quickly the responded.

Thanks for writing to us. I am sorry to hear about what happened with
these listings.

Your credit for the insertion and Final Value Fees for these items has
been approved and posted to your account. You can verify this by viewing
your Account Status.

Now if they would just fix the feedback.

Anyone know where I would begin to get a court order for Ebay to release all the info they have on the seller that did this..I am going to sue them for libel or defamation.

The feedbacks comments are unjust and what he has done has really pissed me off.

And spend more time, energy and money than you will ever recoup. You are a professional. Act like one. Accept that sometimes reality sucks and move on. Why are you letting some little twit occupy so much of your time and energy that could be better irected towards the next hot sale item

Ebay UK has a different way to handle feedback

E bay has NO common sense at all when it come to this silly feed back game. They seem to relish having the very people that MAKE THEM the money look bad for no apparent reasons.

Insanitiy!!!!

Oh well...........

I think that you may have to request feedback removal several times before they do it and then be patient. I know some have had feedback removed for lesser reasons.

Doesn't it fit this criteria?

"Campaigns to harass - Participating in an eBay transaction with the intent to leave feedback as part of a campaign to harass one or more members."

http://pages.ebay.com/help/policies/fdbk-feedback-abuse.html

Here is another page.

http://pages.ebay.com/help/policies/feedback-removal.html

Keep trying. You may actually contact a rep that cares enough to listen.

(Thinking out loud here) Feedback is for completed transactions. The fact that eBay has already credited your fees or will be very soon is basically eBay's acknowledgement that these were not valid transactions. Heck, they have suspended the buyer. If they are not valid transactions, there should be no feedback...have you tried this angle in your correspondence with them?

Since this guy is now NARU, you can file your NPB and your FVF right now. Ebay cancels the time frame restrictions and allows you to file asap. I would do that and move on. Ebay will get to keep their listing fees, but at least you can get your FVF's back now.
