Chessguy joins AW....Starts to fish....Gets TONS of bites...All this within 1 minute of joining AW...This has been with out a doubt the most entertaining thread that a die hard lurker...Thats Me...Could hope for!! CHECK WHEN THIS GUY JOINED AND CHECK THE TIME OF HIS FIRST POST.....

me thinks tammysue put the thread up here in the first place under chessguys name
for laughs and to see what reaction would come of it-look at this post she made awhile back

The legal "advice" rendered here goes from laughable to more laughable. I have yet to hear from anyone who is a practicing attorney, admitted to a bar, in good standing. Got one? I live with one.

..tammysue maybe, or maybe the "teacher" who earlier got herself castigated, or the lurker who came to the surface..or its maybe you - or me..but then, it couldnt be me; i am not that creative.

..while being labeled "laughable," the thread has its value - even if a complete fabrication..

..it did make a diehard lurker take the bait..if for no other reason, the lurker had to tell us[everyone else on the thread] how much he enjoyed our entertainment..he needed us to know that we NOW knew he was die hard lurking..it seems important for some to know that others know about something they are doing..

..and i guess this is also my OPINION, but the advice expressed on this forum is given by people who honestly[and candidly] desire to help..

..if this was some kind of joke, then the ONLY loser is the jokester..no one on this forum meant anymore than to help..granted, there were some "tangents taken." WHICH IS ALWAYS PROBABLE IN AN OPEN-PUBLIC FORUM..and more especially, when the mix contains as many "battery-acid" strength personalities, as this forum contains!

..so, while i dont find thread laughable, it does have its humor..

..the more i know, LIKE YOU, i strongly suspect that this entire excerise is a farce..a fabrication..

If this is a troll thread I do feel sorry for someone else who does have a legit problem that my come here and try to ask for help in the future.

All, I apologise for not getting back you all sooner. I did speak to an attorney and he advised me to not say anything on the case unitl it is settled. Thank you all for all the feedback and responds.

By the way I have been visiting the board for way over a year maybe two, and used to post under a different name. This is my first post under this name because I let the other name expire when vendio requested a CC to join.

Anyway, once the case is settled, I will come back and fill everyone in on all the details.

If this is really happening this gives a new meaning to eBays feedback system. I do have to tell you I never leave a negative. Neutral has been the most I have left. In this case I agree that a negative should have been left. I guess to CYA in your description or TOS everything HAS to be covered right down to the marking of the items sent to the buyer.

Or! Or were they just more threats sent to you by HIS attorney. Why would HE hire and attorney IF HE himself is one. Kinda like me hiring a realtor to sell MY house when I in fact am a realtor.(former, in my real life) Why would I hire someone else to do a job I am licensed to do?

Whether this instance is real or not makes no difference. It has already happened to someone else-- see my posted links to a real case about a FB lawsuit.

Some papers were delierverd from his lawyer, and my lawyer is looking at them today as they were delivered yesterday afternoon. I do not belive he himself is a lawyer.

myoldtoy, my apology if my previous post came out in a neg. tone. I just wished this whole thing was a joke, but it is not.

it may be worthwhile to ask your lawyer to speak to ebay legal dept?i am sure they have seen cases like this before and may advise you what to do.

...my only curiosity is: does the served papers threaten[cite] you for defamation, as you stated in your first thread???..it seems, to me, that this is the only salient point in your statement..and how he will proceed against you..

At this point you are right. However I can see the day coming where feebay will no longer be able to hide behind that excuse.

I'm surprised our courts have any time for legitimate cases with all this nonsense going on.

When my son was 10, he was at a school bus stop with several other friends including a girl. He was swinging his backpack around and accidentally hit the girl with it. She went home crying to her mother who called the police. The police took a report after talking to my son and the girl and sent it to the juvenile court. They (the police and the child's mother) wanted to charge my son with assault! Anyway, before I knew any of this, I had my son call the girl and apologize. Even though it was an accident, he shouldn't have been horsing around. I hit the roof when I found out not only did she want my son prosecuted for assault, she wanted to sue me as well. I called the juvenile court who gave me to the person the papers went to. He laughed and said there was no way they were even going to pursue the case. It was nonsense and they didn't have the time to deal with nonsense cases. Needless to say, despite all her threats a lawsuit never came about either.

Doesn't this guy have anything better to do? Or, is there an underlying motive like eventually suing eBay? People in this country are lawsuit happy. Anything for easy money even at the expense of innocent people.

..i dont know whether to call you a dreamer or not..but i applaude, if you have the self control not to NEGG when deserved..on the other hand, i refuse to let the bad guy win..

..when i say "dreamer," i refer to the CYA part of your thread..it all cannot be covered... the NEGG is a tool;; it will be used, no matter..
..i have always felt that the freedom with which the f/back tool is used, makes it a devilish tool..

.. my state has a law providing severe penalties for "theft by intimidation," ..well, sometimes the feedback system might be described as:: "intimidation by threat."

..after getting 4negs over past 5 years, i probably think my situation thru differently than i did earlier..but the one thing for certain, if you NEGG someone, you most likely gonna get it right back!

The day already came and the Fed courts ruled that eBay is just a venue.


It's happened at least twice. First was the fake sports memoribilia -- eBay was not liable for the fraud, even after being notified, because eBay is just a venue.

The second was a copyright case. The owner of the copyright notified eBay about the infringing auction and eBay refused to take-down the auctions. However, the copyright owner refused to use the notification form MANDATED by the Federal statute -- which includes the perjury statement, as well as other information. The court ruled that eBay was improperly notified and therefore, as just a venue, was not liable.

Did anyone catch the Judge Joe Brown show where an eBay buyer tried to sue a seller (I happened to catch it at 1:00 a.m. while writing eBay descriptions one night). The guy waited TWO YEARS to discover that what he thought he bought (signed Beatles memorabilia) wasn't authentic. He lost. Takes a lot of nerve to expect your money back and damages after two years.
