Please, has anyone had any experience like mine. Ebay closed an auction on an item saying I was infringing on LOUIS VIUTTANI's name. It was a clutch purse. They said to get in touch with the legal rep for the company. The law firm did send me an email also.

What I want to know is why me? There are hundreds of that product up for auction all over ebay. Does any one know why one person would get singled out?

I had the same problem once with the MOSSIMO company.. however in my case they waited till my auction had closed with a bid and then like 7 days later before they filed a complaint... Of course by this time i had already received payment and the item had already been shipped... in my case they claimed that they didn't make an item with a logo that was on it... funny thing to me was that i have seen hundreds of "their" artical witht the same exact logo on it... I think the companies listed in the VERO often abuse the system.. what i would like to see is that the should have to provide the proof that they didn't make said items before they make the resellers prove the item is what they claim!!!

You most probably were reported by an ebay viewer. Any registered ebay viewer can report whatever he thinks might be a violation of ebay's terms to ebay's "Safeharbor" division. Ebay itself doesn't seem to act against anything unless it's reported to them by someone (ie: they don't have an employee looking for violations).

I gather neither of you denies you're selling brand-name knockoffs?

With mine stuff seeing how I am usually selling used clothing, anything is possible although I do try my best to make sure that the item is the real deal I am sure that a fake one will slip through once in a while but for the most part if things don't look right to me, I won't offer it on my auctions. according to ebay the only people that can complain under the VERO are only people who represent the manufacturer and not just any ebay user..

companies like meissen will check ebay and look for fakes.
the intent is not so much to go after the individual who may have one piece to sell but to trace it to the maker of these pieces, like cockroach, you find one,you know there are more out there!!
same with swiss watch companies,or french jeweler coco chanel.
