On February 4, 2002 at 3:58 PM EST, I received several e-mails from PayPal confirming that payments had been made to a third-party through my PayPal Account. Upon receipt of these notifications, I immediately logged into my PayPal Account to investigate these unauthorized transactions. Apparently, someone had hacked into my PayPal account and was able to transfer money from a combination of three (3) different accounts. I immediately changed my password on the account to help protect myself against any further unauthorized transactions. After I changed my password, I called PayPal customer service to report the four (4) fraudulent transactions that occurred on my account. The elapsed time between the e-mail notification of the unauthorized transactions and the phone call I placed to PayPal customer service was less than 5 minutes.

PayPal customer service told me that there was nothing they could do about the transactions because they had already been “approved”. However, they told me that their investigation department would look into the fraudulent activity as soon as I signed, notarized and mailed their standard Affidavit to the PayPal investigations department. I complied with their request, followed their rules and procedures, and keep my verbal dissatisfaction to a minimum. To date, there has been no resolve, they have my money, and it has now more than 17 days since the fraudulent transactions occurred. PayPal is now in breach of contract with me as outlined in their Terms of Use posted on their web site.

In the PayPal Terms of Use Section VI.1.c, they state the following: “We will tell you the results of our investigation within ten (10) business days after we hear from you, and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) calendar days to investigate the complaint or question. If we decide to do this, we will provisionally credit your transaction account within ten (10) business days for the amount you think is in error, so that you may have the use of the money during the time it takes us to complete our investigation.”

I have done my due diligence on PayPal….and I have a good idea of what is happening! It seems that I am not the only one who has experienced problems with PayPal and their dis-honest business practices. I have a good feeling that they are dodging my claims, along with other who have had similar problems of having accounts frozen, because they have taken the money and used it elsewhere. Then, users want try to withdraw the money that is rightfully theirs…and PayPal doesn’t have the money to return. PayPal’s business practices and claim resolution techniques are unprofessional and fraudulent in their very nature! If I ran my business like PayPal runs theirs, I would be looking for a new job! But in the meantime, PayPal has stolen $1,642.00 from me….and as I suffer from these lost funds, PayPal executives are filling their pockets with their IPO!

I am currently researching my options for legal recourse with PayPal. The level of service and support I have received is unacceptable. I have records of all fraudulent transactions along with every correspondence with PayPal customer service.

Any suggestions?

Hi denalidesigns,

As long as the claim is approved, and the information you supplied is complete, you will not be out any money.

You are currently (based on your post) on the 17th day. The claims can take 30 days to process.

You are more than welcome to contact me ([email protected]). I will see if one of the reps in that department can give you an approximate timeframe on the completion of the claim.

Ohhhhhh ... so MY claim should be processed in 3 days, huh? I'll believe it when I see it. My PayPal account was hacked on January 26th and 4 transactions totalling $2,950 were sent. I'm sure PayPal is working diligently on this <insert sarcasm here> and will have my funds returned within the next 3 days.

But please explain to me why it jumped from 10-days to 30-days. Hmmmmm ... according to your user agreement: "We will tell you the results of our investigation within ten (10) business days after we hear from you, and will correct any error promptly." So when did this user agreement change and I why weren't your customers informed of this? What ELSE has changed that we aren't aware of (besides the fact PayPal keeps swearing they were NOT hacked???).

I'm just fed up with all the BS from Damon and PayPal. They won't answer emails (except Damon DOES offer to "forward them to the appropriate department" ... lot of good THAT does), they won't speak to me on the phone (1 HOUR AND 19 MINUTES ON HOLD), and won't respond to snail mail either.

Now I'll just sit back and wait for Damon to go into his little spiel about protecting your PayPal password and never going to one of the spoof sites. He must think PayPal users don't have a brain cell.

This is just one of several e-mail that I have had to send out to people that have tried to pay me through PayPal. If I can ever get what people have sent me through PayPal I will return the funds to the people that have tried to pay. I did send out some bumper stickers to one buyer but that was because I thought I was going to get my payment from PayPal but instead just another run around.
This part will be hard to believe but I never set up an account with PayPal in the first place. A person that I do not know that won a couple of my auctions and would not take no for an answer did and even set it up with a password that of course I did try and change. I still have the proof of this if I ever have to go to court with it and one day if they keep stealing people’s money on the pretence that I will get it we may have a court day. I know that I am a small person against a large thug but I will go down swinging if I have to. That’s one of the problems in this county today (CORPUCTION) and I think PayPal is one big part of that problems in this country. Just for the record he (the man that set up my account, with me telling hid I was not interested in PayPal to start with) never got his items either and tried his best to get it settled with no help from PayPal. Regardless of what some may think unless they have closed that window others can set up an account in your name but if they do not have all the information needed to do so, than people that try and pay through them will only loose their money and that is where we stand now.
I have never been a true member of PayPal because I do not agree with their policies to start with and sure don't now. I think that they are a pack of thieves and one day they will take a lot of people for a lot of money and every time I try to clear all this mess up the more I feel that way. Everyone thought ENRON was a great thing also, but they don’t think so now. What you should do now is see just what they are going to do for you on this matter. Let them know that I will not ship and also let them know that you have talked with me just to find out that I have in fact tried to close out the so called account that I have with them. My wife tried to talk to them on my behalf and was told that the account was not in her name and they couldn’t help her, so she offered to get me on line with her and they just hung up on her. They sent me email and said if I would give them a 2-hour open window that they would contact me and we could clear all this up. I did as instructed just to wait for nothing than I did what I said I would never do and give them my home address because they do not mail out payments to a PO Box # and that is what I use because I live in a high crime rate area and I pay over 100.00 a year for the PO Box # to insure that I get my payments and so far no bad luck as far as the PO Box goes. Now they tell me that they want my bank account # and canceled utility bills to prove who I am. I am sorry but they have got all that they are going to get from me and if they think that I am not who I say I am than they should stop taking peoples payments in my name. All they would have to do is let the buyers know that they will have to make other arrangements until thing are cleared up. I can guarantee you that they will not inform you of that because they know if I don't get your payment. they will just keep it themselves. I am in the process of trying to build another data file of all the wrong that they are pulling. I had a large one and my computer crashed and I lost not only that but all my ads. I had to replace a complete hard drive. I did have some items that I could recover that I had sent to my wife to keep for me. Feel free to use my email that I am sending to you as it is a fact and I am not worried that someone can say I am trying to harm them. The fact is they are harming me and all that put their trust in them. Please forgive my spelling and grammar as I am not so good at that but at least I am up-front and honest in my dealings and that is more than I can say for PayPal. Before you use them any longer take the time and go to their policies and read all very carefully and than see if they are something that you really want to give access to your business and bank accounts. Remember that you over looked my warning that I do not except PayPal in large letters, imagine what you might have overlooked in small print that they provide you and if you agree with all that garbage than you can be a member. Keep in mind also that they promised that they would be free and now you have a very small limit and it in not free any longer. To me that is just like a man's word, if it is no good than neither is the man that spoke it. I don’t mean to try and write a book but I feel that you should at least get an idea as to what is going on and why I have taken the stand that I have. Please try and see if PayPal will try and help you. If I am in the wrong let them take me to court. Bottom line is, they will just ignore you and hope that you will go away as you are only one yourself. So you don’t use them any longer, so what, for everyone that drops out 10 will sign on and the chain goes on. Remember every thing is great until something happens to you They have had my money sense they where offering you $10.00 to join and you got it. I didn’t get that either.

I can't determine your issue based on the post. Can you please shorten the post? I would like to address your concerns.

No payment is accepted on your behalf if you do not have an account. The sending party owns this payment until you claim it. I also dont understand how someone set up an account for you.
