This email was sent to Damon Billian and Aric Yochum at 12:17am on 3/27/2002. I am posting it here so those of you out there with similar problems can follow the trail and see what kind of resolution I receive with this course of action. Furter comments can be address to my email at [email protected]. Thank you.

----------------------------

Damon and Aric,

I have a problem with my account. The telephone # it is registered to is xxx-xxx-xxxx and the email is [email protected].

My account was restricted last week due to the fact it was drawing on a bank account that was inactive. As soon as I realized the error, I changed my account and credit card information, assuming that the transactions would go through again in a few days using the new account information and there would be no problem.

But the transactions were attempted again using the old information which had apparently been removed from my account. The transactions bounced again and eventually resulted in a negative balance (roughly $44) in my account. My account was also restricted at this time. Assuming it was due to the negative balance I immediately initiated a transfer from my bank account of $150 to cover the negative and to pay out some auction payments I needed to make. I contacted a gentleman in Customer Service named Christian (I believe) who told me he would immediately file a service request but it might take until the EFT cleared before the restriction would be removed. Strangely enough, the restriction states I will not be able to add/remove funds from the account but the transfer went through without a problem and now my account shows a balance of roughly $100.

My account is still restricted. I contacted Customer Service again this evening and spoke with a girl named Jenny. She stated that there is no way I can withdraw my money, change my information, or close my account until I fax the required info to Paypal. I have no intention of faxing my recent account transaction information or credit card information as it is personal and I do not believe Paypal has any right to investigate my personal spending or bank matters. It is quite obvious that I am acting in good faith (note the positive balance in my Paypal account). Nor do I have any intention to fax a copy of my driver's license or other personal information which could be intercepted by any malicious party up the line and used in any form of naughtiness.

This email is to inform the two of you and Paypal, Inc. that I am demanding the restrictions on my account lifted by 7pm Pacific time on March 29, 2002 so that I can clear and cancel the account. This gives Paypal, Inc. more than three full working days to allow me to remove my money from the account. I have already retained my own lawyers to handle this matter should COMPLETE resolution not occur by 7pm Pacific time on March 29, 2002. We have already begun researching how this dovetails with the current class-action lawsuits brought against Paypal, Inc. by Jacoby & Myers and Girard, Gibbs, & De Bartolomeo, LLP. I have also readied signed formal complaints addressed to Nebraska Attorney General Don Stenberg, the Nebraska Department of Justice, California Attorney General Bill Lockyer, and the California Department of Justice.

I would remind the account and appeal specialists at Paypal that the current balance I wish to withdraw was deposited to IMMEDIATELY cover the negative balance. I am acting in a full good-faith capacity to zero my account and will not, under any circumstances, attempt to deceive or defraud Paypal in any manner. I merely wish to retrieve the money that is mine and cancel my account.

Thank you in advance very much for your prompt resolution to this matter.

why dont you send them the documents by priority or express mail instead of faxing??
how did you hook up an inactive bank account with your paypal account in the first place??
you are just speculating someone is going to study your cc and bank account details in depth or make naughty use of your driver license id?
i bet paypal staff is up to their gazoo?? with faxes, they can probably make a fluffy bed with all these faxes and sleep in the office overnite instead of going out and buy some foldable cots?

Because I have no intention of sending them the requested documentation.

It went inactive after I sold my business, it was the account I used for many years of loyal Paypal transactions.

I'd rather not supply anyone who already has my checking information with my SSN#, DL#, picture, copy of my signature, and copies of utility bills and bank statements. You ever notice how many businesses use these documents as proof of identity?

Hi,

I do believe this account issue is currently resolved. The problem was caused by the negative balance on the account (because of the old bank information), which you have since corrected.

Thank you for your patience.
