Hi - I purchased an item on ebay and paid the seller via paypal in Feb 12, 2002. Up to now, I still have not received the item purchased (Computer RAM).

I contacted the seller without any luck. I finally contacted paypal and put in a complain to get my money back and still have not heard from them.

In order to protect myself, I will need to notify the credit card company of the fraud. The main question I have is whether my account will be restricted if I do so. Please keep in mind that credit card company has limited time to reverse the payment.

I guess this question fall on paypaldeamon. Please advice.

Paul your damned if you do and damned if you don't. So get your money out of them and then file with your CC company. Remember the words "when it comes to ****** just say NO"

Wait until the time limit almost expires (i.e. a week before the 60 day period for reporting the fraud is up). At that point, if you do not have all the money from the complaint in your possession, file the chargeback whether or not you received any information about your buyer complaint from PayPal. Even if PayPal says you won the buyer complaint and is going to credit you the amount do not accept that until you actually have the amount in your bank account. Remember, a Pending Reversal means nothing, so don't get your hopes up if you see that.

If you do not have possession of the money, then just assume it as PayPal has not responded to your buyer complaint and file a chargeback with your cc company. However, I would definately remove all money from your account. They sometimes do (from many stories I've heard) restrict accounts that file chargebacks even if the user filed a buyer complaint. Also, it generally takes around 3-6 months after you file the chargeback before PayPal even realizes you filed it, so you have some time to remove the money from your account. However, I would remove it all before the chargeback, or at least start the process of withdrawing it to a check or a bank account (or debit card).

Hi paul1234,

Our terms of use do require filing the Buyer Complaint before filing a chargeback. The buyer complaint process will take 30 days from the date you filed the claim.

I would recommend, if at all possible, waiting for notification on this before filing a chargeback with your credit card company (most card companies allow for 60 days from the date of the transaction to file a chargeback, but this is something you would want to confirm with your card issuer).

is the seller still selling on ebay??
does he have any money in paypal account??
if you are the high bidder of an ebay item,you are covered by ebay insurance.

I recently went through the same thing. I informed Paypal the next business day after my payment that I believed the seller was commiting fraud. Of course, they did not investigate until 30 days later at which time the seller had no money in his account. I then filed a chargeback with my cc company. My account was not restricted until about 4 months after my chargeback. Of course, I kept as little money as possible in the account since I felt it was coming. I had $0 there when it came down.

Thank you for your responses. This seller no longer sell on ebay and no where to be found.

Paypaldamon: I check with my credit card company and the time limit to find is 60 days. I filed complain with paypal at 28th day and received email that they will not response until 30 days. Which will put me into very close to time expiration to file with credit card company.

I would appreciate if you can look into this. Here are the info:

Transaction Date: 02/24/2002 6:51:17 AM
Transaction Amount: $746.00
Seller's Email: [email protected]

Typically, a credit card would not cancell my account if there is fraud committed. However, based on my reading here, many people got their account restricted because they filed charge back with credit card company of fraudulent transaction.

Please look into this and advice.

if the seller is no longer selling on ebay,is he now not registered with ebay and are there mucho negative feedbacks in his file?
unless someone has reported him to paypal before you and paypal has locked up his account,then this seller probably will have zero in his paypal account.
you will get something from ebay insurance ,under 200 dollars.
