My Auction ended on Nov. 16th. On that day I sent an EOA Email to the buyer, Received no response, On Nov. 24th I sent another email, to the buyer Received No Response. On Nov. 27
I sent another email to the buyer, Received No Response. On Nov. 28th buyer contacted me and said checks got stolen from the Postoffice, I said "ok I will waite alittle longer, By Dec. 9th I emailed buyer saying, please send payment because I have waited long enought. Buyer said payment is in the mail.
On Dec. 15th, NO PAYMENT CAME, I emailed buyer for an update, buyer never responded.
Dec. 18th I filed for NPD alert. Still no response from Buyer.
Dec. 28 I left buyer a Neg. feedback.
On Dec. 29 I filed for a Credit request from Ebay. Right after that was done, Buyer contacted me and wants to know WHY ???????
Buyer said why did you do this, was it for spite. Buyer said they sent me a email telling me payment was being sent by Fedx.
I told buyer I never received an email, and I always get all my emails.
I told buyer WHEN CHECK DOES ARRIVE I WILL SEND IT BACK, BECAUSE I DON'T HAVE THE ITEM ANY LONGER, I SAID THAT I AM NOT OBLIGATED TO HOLD AN ITEM FOR 45 DAYS.
BUYER SAID I hand no right to ask for a credit since I REFUSED PAYMENT. and buyer sent my email to ebay telling them this.
QUESTION;;;;;;
Where do I stand and what do I do now????

If they just forwarded your email and it mentions the 45 days, I don't think you have much to worry about.
Sounds as if this buyer was just playing games and for whatever reason thought they could just keep you hanging. Too bad for them. Also they may of not had the money and was hoping "Save" it while you waited. LOL
I wouldn't worry.

If you saved ALL OF THE EMAILS, back and forth,, then write to [email protected], and send them a copy of ALL the correspondence.

When eBay sends a "Reminder to pay your seller" email (the NPB alert) it clearly states that the seller is no longer obliged to hold the item. The buyer would know this if he read the NPB alert. You have nothing to worry about.

I just got done with a problem like that. This person had the high bid on a 8.99 item. Three weeks went by and no payment. I e-mailed her and she said that she thought she had paid using paypal, so I thought maybe I did mess up and check payments received in my paypal account, well as I had thought there was no payment from her. I e-mail her again and let her know that I found no record of her payment. She said Ok she would pay using paypal, a week went by no payment, so I e-mail her again, this time she wanted my to send a payment reminder using paypal, so I did a week went by and I sent her another reminder notice. She then responded with everytime she tried to pay using paypal it was down. That was another week. So yesterday I went in to ebay and ask for my refund of charges for this sale and then left her neg. feedback. Guess what she left my neg feedback, said I only sent auction request, not personnel e-mails. I thought of all the time I had gave her for payment and all the emails I had sent her. I responded to her neg. feedback that you gave me with: no payment/ upset about me giving neg. feedback because of no payment. I now have 5 neg feedbacks and they are because I left neg feedback for non-paying. We need to all get together an ask Ebay for something better. If you don't pay you should not be able to leave neg feeback. Thank God out of the 100's of items I sell on ebay, I only run into 1 or 2 every so often.

I know exactly how you feel, I went to check my buyers feedback and there was 11 positive and 11 negs. and the response she ans. the neg. I left was..I should read my email, Uh!
I told her she is the last one who should tell someone to read there email. She didn't leave me feedback yet, I am still waiting.
I told her if you are going to respond to the neg. feedback at least say what really happened, don't tell stories.
I would like to know, with all her 11 neg. feedback why is she still allowed to place bids?
You see, the buyer who puts you threw hell is always the first to point a finger when you follow the Ebay rules, They want to be showned as *****Poor me, look what the seller went and did, Why????????????
As a seller I felt I had to let other seller know what they might except.....
Plus all the time that passed waiting for payment I never went to check the buyers feedback, which I should have done.

Because her FB hasn't reached -4, and also probably that not all sellers negging her have either filed for NPB/FVF or alerted SafeHarbor to this deadbeat.
If you were so inclined, you could do as I did in your situation and contact the other sellers who've negged this bidder, and ask them to file for FVF if they haven't already and email SafeHarbor about this jerk. We had one deadbeat who got 23 negs in less than 2 weeks, but enough pos FB to keep her in the black. En masse we emailed SafeHarbor, and THEN bidder was NARU'd within 24 hours.
