Pat ... OK to temporarily close the original thread. I understand this from Michelle's email to me. I also understand that this thread will be reopened in 24 hours regardless of whether or not the identified seller accepts the invitation to participate. Please correct me if I am wrong.
In the meantime, I must once again try to make my point with 'twinsoft'. I will reference his last post from the closed thread here:
"RB, you're only telling half the story. The auction that eBay ended, the one that led to your suspension, stated "copy down my email address so that if eBay ends this auction, you can contact me and purchase from me direct." That is a clear violation of eBay's "no direct-sale" policy."
You are correct. However, eBay had previously ended an earlier auction of mine (several months ago) under identical circumstances. In the case of my "V" tape auction, I actually contacted eBay before I listed, asking them if my wording was OK. I gave them a week to respond with a yes, no, or request for proof. They didn't respond at all, so:
1. I assumed it was OK, and,
2. Based on my previous listing that was also incorrectlt ended by eBay, coupled with the number of emails I received afterwards from lookers asking what happened to it, I felt that, just in case eBay did their arbritrary thing AGAIN, I would include my email address in the latest listing.
I honestly did not realize that by including a "link" to my own email address, I was committing an eBay crime, particularily in light of the fact that thousands of eBay sellers include real links to their websites that offer off-eBay sales of their product. For this I am guilty and my only excuse is ignorance.
I suggest that if you had a perfectly legal auction for software ended by eBay for no legitimate reason, you would probably include a similar note in your 2nd attempt at listing to give your lookers an opportunity to contact you if eBay ended the auction again for no legitimate reason.
"This was most likely a repeat offense since eBay doesn't suspend without issuing a warning first."
The only other warning I received from eBay was the same as I received on this one, and that is 'potential' copyright infringement. I both cases, eBay were simply wrong.
"You have alerted the seller and eBay, and I would suggest for your own mental health and mine that you drop this subject finally."
That's not going to happen, and my mental health is fine thank you I have my reputation to protect. OTOH, your mental health may be saved by you simply blocking out any further posts from me. I believe AW offers this capability.
"I understand your anger at what you perceive to be an unfair suspension, but what you failed to mention in your post is that eBay has offered to reinstate you if you will only provide documentation that your tapes are legal."
There is no incorrect perception here. It's too late for me to provide such documentation to eBay. The damage has already been done and my stubborn ire has been awoken. Please re-read my previous thoughts on the repercussions of false accusations.
"All you need to do is send eBay a scan of the tape label, yet you continue to drag this issue on and on."
I could do better than that. I could FAX them the 10 invoices from Columbia House proving that I am the owner of the original factory released tapes, and a .jpg shot of the entire set. But, it won't matter. If I get down on my knees, face west, and beg for eBay's forgiveness, then decide to relist the "V" tapes, all it will take is an email from you or anyone to Safeharbour, claiming that my item is illegal. Then, we're back to Square One, except now I will have been warned 3 times by eBay I would get a double-indefinite suspension, and never get out of the penalty box!
"Let me explain eBay's policy. eBay doesn't "investigate" copyright violations."
You're right again, but why do they use this term when they end my auction? I know they don't investigate squat, and I have been saying that for months ... to tell us that they do as a reason for ending an auction is an outright lie.
"I'm not in the mood for a smear campaign based on your half-truths."
Your choice my friend ...
I eagerly await the reopening of my original thread. I feel I have been burned by eBay, and like a leech, I don't intend to let go until they offer me a written apology. I am not asking for reinstatement for reasons stated earlier ...

posted on December 30, 2000 11:20:35 AM newRB First of all you have no proof this seller is not selling something legitimate. But I have a question for you, If you had not been suspended from eBay, would you still be trying to do this to another seller?
All I see is conjecture and inuenndo being tossed about and no real proof.

twelvepole ... Yes, I do, and yes, I would. As to the proof, that will become apparent when Pat reopens the original thread.
By starting this thread you have defeated the purpose of locking the first one. This subject may not be discussed until the 24 hour period has passed or until we hear from the seller.
I'm locking this thread. Please do not start another on the same subject.
