After two years of nothing but positive experiences as a buyer on ebay, I think I've been zinged. Here's the Reader's Digest Condensed version of the history of the transaction:
In Oct of last year(2000), I won two auctions by the same seller. Paid for both items by Bidpay. Received one item in a timely matter. The other item didn't arrive.
Contacted the seller, asked if they sent the package. They responded they had. Waited a while longer. No item. Contacted the seller again, to let them know the item was still MIA and to request the tracking number. They said they'd get right on tracking the package. 8Dec00 was the last I heard from them.
Today I decided I've been more than patient and sent an email requesting a refund ASAP. The email was kicked back to me as undelivered, "a permanent error". I go to the auction page and discover, to my growing dismay, that the seller has made their FB private and that they have received 24 negatives in the last month.
I've requested their contact info and will call them if necessary(even if it is an international call) to find out what's going on.
O Learned Ones-do you think I should go ahead and file mail fraud charges without waiting any longer?
Thank heaven it's not a large amount of money, so it won't hurt if I never see it again.

yes!!! File mail fraud charges!! good luck to you. Even if you never see your money back, hopefully your efforts will keep that person from a repeat performance. I hope you nail that loser!!

If you paid by Bid Pay how does mail fraud fit into this? I would suggest you get the contact information and go from there. Have you tryed Ebays insurance? Does bidpay have any recourse?

Mail fraud comes into play if any part of the transaction takes place under the aegis of the U.S. Postal Service, such as the delivery (or non-delivery) of the item.

File the Mail Fraud complaint now...
It DOES apply as mail fraud, as the US Postal Service was used to deliver the money-order to the crook, regardless that it was sent by you through BidPay.

I called and got a voice mail number. Left a message.
Got an email back telling me they were going to be shipping my item soon. Shot back another email pointing out they had told me it had been shipped way back in Nov.
I have requested a full refund.
And I'm gonna file those mail fraud charges, too.
My tail is starting to swish and is in imminent danger of fluffing...
