Hello,

This is going to sound crazy but it's the truth. I have a crazy former girlfriend who I have had to bring to court for an order of protection to keep away from me. We are still in court becuase her attorney has asked for a continuance so we don't go back until early January.

I beleive this same girl notified Ebay with some false information leading to the suspension of my sellers accoutn that had nearly 400 feedbacks. I have asked Ebay who wrote to them in the "community" and they will not tell me and ignore my requests for more information.

Here are my questions if anybody out there has an answer.

1. Do you know if Ebay keeps that type of information on file as to who ratted out who in their community policing?

2. Where would I send a subpoena to Ebay from my attorney to find out such informaiton?

3. Will Ebay comply with the subpoena and do they have to?

4. What if the member that did this was suspended at the time and used their new name to pull this off, is Ebay responsible at all?

Thank you in advance. I'm not looking to sue Ebay I just want more solid evidence that this girl is a freaky stalker and this would be solid since I make my living off Ebay now and she has ruined my account for nothing. Any suggestions or answers to my questions would really help a ton. Thank you again.

My advice to you would be to let your lawyer talk to ebay.
They will respond on a legal level a lot faster than they would to you.

Best to let the legal beagle sent the subpoena.

You may have a case against your girlfriend if you can prove she provided ebay with false and dentrimental info.

Ebay has a right to suspend your account to investigate whatever it is that is reported to them if they think you violated one of their rules. Doesn't matter if the user who reports an incident is curretnly suspended.

Ebay won't volunteer its records to you, but you may be able to subponea it, I'm not sure. Problem is, you don't even have proof if your the suspension has anything to do with the girlfriend. Check with a lawyer on that.

Your lawyer can find ebay's address if he is going to send a subpoena, that's what he's paid for.

The California Secretary Of State's Office (Bill Jones) can provide you with the address and party for legal service for any Corporation doing business in California.

I'm not sure where to send a subpoena. You might try reading through their financial statements (try FreeEdgar.com, just look at the most recent 10K), or on the About eBay page, investor relations page, etc.

As far as having the lawyer find the address, I think your instincts are right. You will be more informed if you do a little detective work yourself, and it will cost a lot less if the lawyer doesn't know anyway. Sure, you're paying the guy, but why pay him if you can find out the same info yourseld?

What kind of detective work are you talking about? Ebay automatically sent me a form [email protected] letter like they normally do. I am farily proficient at using Ebay and I can't think of how to do any kind of detective work for this. My email is [email protected] if your suggestion is something that you don't want to post. Any advice would be great. Thank you for all the quick replies I have received so far.

You haven't said why you were suspended and your auctions are all private. Also, it looks like you still have a few auctions running.

It looks like you are auctioning event tickets. You should know that it is a violation of eBay's rules to sell tickets at greater than face value.

Hard to know without more information.

hire your girlfriend to peddle those tickets for you,commission only,no sale no chow.
act like a boss,chew her out if she does not perform,someone like that you have to turn the table and give her a piece of her own medicine.
save the lawyer fee,bring out the whip and give her the boot

As amusing as that may sound, I don't want this person near me. She is a stalking freak, belive you me. I would go into detail but anything I say can and will be held against me. Love is a funny thing you know.

twinsoft: FYI it is illegal to sell event tickets for more than face value in some states. You have to check the eBay information page regarding event ticket sales to see if it is illegal in your state.<br />

I used TWINSOFT's phone number provided and called Ebay customer service and they told me the following.

We only chart the reason why you were suspended. If somebody wrote in to have us check into a matter leading to your suspension we don't write that name down.

Do you believe that or not? Just wondering, it seems kind of silly to me that they wouldn't.

Now wait. I was having a email conversation with ebay and I said I would like to talk with them on the telephone and they told me that they do not have telephone conversations with their sellers. Did you really talk with ebay customer service? I really doubt if he said she said would get you kicked off ebay but maybe I am wrong. Did you have an auction that wasn't legal? Think back and maybe you will find it. Selling tickets for over face value must be legal on ebay because just check and see some of the football tickets that go for a large amount. Good Luck

Ebay does indeed have a customer service phone number and does talk to customers. Though they do not advertise it hardly at all, as they are not really setup to handle it.

PowerSellers also have some direct lines and e-mails to ebay.

As for not tracking who reported what, this is one thing that ebay will not tell you the truth on. They have a system called InfoGlide. This system notes IP addresses when you register (though many claim they do not, they indeed do), and the system even allows for notes to be taken about a particular case. It also keeps tracking of your suspension information such as date and times recorded and how many offenses.

Mostly though the InfoGlide system tracks fraud and offenders via the billing system. Seems that InfoGlide has developed a system that basically looks for "flags" and assigns a point system for the likelyhood of fraud. They can also do extensive billing searches in the system to see if a name, street, phone, card number, etc matches with any other account.

The ebay Infoglide system is very extensive and one of the single most guarded secrets on ebay. I, however, have actual documents on the system and even a few screen shots. So I do know some things about it and have seen it in action.

Ebay doesn't have to give you any information. Even with a subpoena, unless you are suing someone, and even then to what level or degree they have to cooperate is questionable. While they cooperate with law enforcement and with major fraud cases, it is very doubtful you will get information from ebay. Even with a lawyer.

Tell my why you have private auctions and then the buyers leave you feedback with their eBay name? Doesn't make sense to me.
I also thought with all those negative feedbacks you would have been suspended long ago. Just how many negative feedbacks do you have to have, to have ebay suspend you?
Just wondering...
