I recently used Paypal to complete an online transaction on Ebay. Upon arrival the item turned out to be 1 step above junk. I have contacted the seller and requested to return it, but he does not answer my emails. If I file a complaint on Paypal, I have to wait at least 30 days or more for action. If I do this, it may exede the length of time my CC issuer allows for a chargeback. What will happen if I file for a chargeback right away from the issuer??

If you used your Credit Card to pay for the item, and not Paypal funds, you should file for the chargeback immediately with the CC company.

you have to return the item and prove he has received the item,which means signature receipt.
he could refuse accepting the item.
when you do a chargeback,what would you say the reason for chargeback is?
if you still have the item and said the item is no good,then your credit card company will ask you why are you still sitting on it if the item is no good?
then you say well i try returning,but he wont accept it.
then you are stuck with that piece of merchandise and you will have to pay.

The item was a computer laptop display. While it may work (I haven't tried it), it is covered with gouges and scratches (some 6 inches long). In CC tranactions, nothing is mentioned about returning the item first, etc, etc, It just says if the seller refuses to make good the CC will debit him. I'll send it back afterward.

I used a CC through Paypal. The point of my question was that I don't want to have PAypal come back and say "oops too bad" and not be able to get a credit from the CC issuer.

If I file for credit from the CC issuer, what will Paypal do??? Cancel my account?? Try to recover the $ from my account by making a debit??

Paypal can freeze your account or cancel it. You are to try thru them first. Check out the user tos on paypal.

If you send the item back and the seller refuses to sign for it, you're not out of luck.

All you need is proof that the item was sent back and the seller refused it, the CC company will still charge back.

I'm going through something similar right now. Paypal only took 4 days to answer my complaint on the quality of goods and of course it was denied. My item was counterfeit. I returned the item to the seller who refused it. I sent it a second time and it was refused again. I used a debit visa card and the bank had no problem refunding my money since I had proof of attempting to return the item plus emails of the sellers refusal to refund. I waited until after paypal denied me to do the chargeback. I don't know what paypal will do once the chargeback hits but I followed their rules.

Another rule to follow- always use a credit card, not a debit card, or a paypal balance.

Hi,

Most credit card companies allow 60 days for chargeback filing.

Have you tried to get the contact information from the seller to discuss the matter by phone?
