Hi, I'm a new poster but have been reading this board for a long time and have learned a lot. I sell mainly in antiques on Ebay. Yesterday I was browsing around in the software category and noticed a cd of some Macintosh software that went off at over 300 dollars!! It was version 1 of a program that you can order from Apple for 19.95! (v 2.0) It was part of the bundle that came with a computer. I emailed the seller to ask about it and he replied right away that he was shocked too, didn't think it would go more than 30 or 40. So I looked further and saw lots of startup disks and system bundles for sale for lots of different iMacs and Macs, all getting bids in the 20-40 dollar range. I checked Ebay's prohibited items page and it looks pretty clear that they don't want you to post software that came with a computer unless the computer comes along too, yet here are all these auctions going on...I know that Microsloth is actively pursuing resellers of it's programs and hope this won't sidetrack into that can of worms. I'm just wondering how all these auctions continue ? Does someone have to report the individual auctions to Ebay before they take any action? I've got lots of old and new Mac system disks and original equipment software bundles at hand...had no idea they had any value...don't want to post them if it's going to risk my account...anybody know what gives?

Your assumption about Ebay not acting unless they are notified is correct. They have stated that they will not act unless someone complains. And they will only act upon an auction that the complaint is on. Meaning if you find 500 illegal aucitons for the same exact product, they are only going to act upon the one the was complained about and the other 499 will remain. It seems kind of bogus that they would simply start looking for related auctions once a complaint is filed, but that is what they do.
As far as your software goes, it sounds like it would violate their rules so sell at your own risk.

For software and such, eBay may not even act if reported, unless it is reported by the owner of the copyright. Under the DMCA, eBay doesn't have to remove infringing items unless the actual owner or agent properly files the complaint with eBay.
