Sorry this is so long.

I used BIN and bought 2 sets of 10 books each from 1 seller on ebay. On 1-30-02. I used great care in deciding which book sets I wanted because they were for my eight year olds birthday (the seller had 5 sets of 10 books listed). I mailed my MO and all was fine until I received an email from the seller (2-8-02) that she thought she had mailed me 1 wrong set of books and could she mail me my correct set of books along with a mailer already made out with postage and everything so I could send the other set to the right person. I said sure no problem. I received a package on 2-11-02 and sure enough 1 set was the correct set and the other was the incorrect set. I emailed her to confirm that she did indeed send me a wrong set of books. The email came back undeliverable.. I waited a day and tried again.. undeliverable.. I sent an email from my other email account and still no response.

So, then I waited for the other set to arrive, knowing that I received the first set in just about 4 days the second set should arrive soon. Nothing. I used question to seller (2-23-02) and finally she responded with- "books were mailed on 2-6-02 If you don't get them within 7-10 days let her know". I responded with question as to which set was mailed on 2-6-02, (as she did not email me about the book mix-up until 2-8-02 and I received 1st package on 2-11-02) no reply from seller.

I then began to worry about the buyer of the other set of books so I emailed her. (2-24-02) She had no idea that her set of books was sent to me and no she had not received her books (wonder why?) and she had not heard from the seller since 2-19-02 and that the seller was sending her another set of books and hopefully we would get answers and get it all straightend out soon. I asked her to let me know if she receives books from seller.

I wait for mail everyday as my daughters birthday (3-2-02)comes and goes and still no books. I use question to seller AGAIN to get in contact with seller. She replys "I don't know what is happening- I mailed them. I am so sorry! Keep me posted. My PO says they can do no tracing unless they were insured. Makes you wonder..."

Okay, why would she send another set of books to the other buyer if she knowingly sent my set of books to me with mailer (with postage)to send books on to original owner?

She does not seemed concerned at all about the fact that I have not received my books nor does she seem concerned about the owner of the other set ,that is not mine, nor does she seem concerned about the fact that supposedly lost in the mail is a mailer with prepaid postage on it. She has no idea that I contacted the owner of the other set of books.

Why does she not seem concerned? Because, I don't think she ever mailed them. I believe that she added up the postage it would cost her to straighten her mess out and decided, what the heck, everybody got the right amount of books so no harm done. Wrong, harm has been done. My daughter was minus a package of books for her birthday. The other set of books that were not mine are just that-- THEY ARE NOT MINE- I know she will never own up to the fact that she never mailed them, but I did send an email to the other buyer with a list of the book set that I am missing incase they were "accidently" mailed to her. I have even offered to send her the correct set of books if she wishes.

The seller has not made any attempt to contact me first about anything other than the fact that she screwed up. I have only emailed her maybe once a week, if that much, to get information about what is going on and it is like pulling teeth to get her to answer.

What would you do?

She has 522 feedback all praise. She is a teacher at a church school. The other set of books are all for 4th and 5th graders, my daughter is in 2nd grade. Yes, they were mailed Media mail. I know it takes time- time has passed.

I paid $5 per set plus postage of $5. Which adds up to $15 for 20 books. great price less than $1 a book. But 10 of these books do not belong to me. HELP!!

Sounds like she is buying time until she can straighten out the mess. She may be waiting for the wrong books sent to the other buyer. She says she mailed the correct books, right? So they should be coming soon, the PO has been slow lately.

The seller was going to send a replacement set of books to the other buyer and never informed her at all that she sent her books to someone else.

According to seller my set2 was never sent anywhere else but to me and where mailed on 2-6-02.

How long does media mail take?
It has been over 4 weeks.

I'd ask her for a full refund for the wrong set of books plus postage to send them back to her. If worse comes to worse and that wont happen, I'd stick the wrong set of books right back on Ebay and sell them so you can at least get your money back that way.

I would take the seller at her word as she appears honest though badly disorganized. You might try taking it to the next level, i.e., filing a complaint with SquareTrade or even a fraud complaint with eBay. That might help shake the seller out of her complacency.

It was the seller's error; you should not have to wait months for reimbursement.

Should I email the seller and let her know that I have had correspondence with the other buyer? Should I let her know that I am aware that she has sent a replacement set to the other buyer?

The sellers last response to me indicated (in not so many words) that without insurance PO cannot trace package. So, I really don't think a refund would ever come about. She has put it off on the PO. She has not even mentioned anything about what to do with the other set.

I have been nothing but nice and willing to help in anyway. I have waited for her to communicate with me and she has not. This was her mistake not mine.

Why am I doing all the work to get it corrected? Because I care about the other person, the one that has waited for their books to come in, the books they selected for their child. That is why I contacted the other buyer in the first place, to let them know that I had not received the preposted envelope to forward them on to her. What shocked me was the other buyer knew nothing about the mix up all.

I did think about putting the other set back on ebay. How long should I wait before doing that? The seller has not said a thing about what to do with this set. Keep it, send it back to her, nothing.

Tell the seller that 1)you still have not recd the correct set 2)What does she want done with the incorrect set since you have no use for them and that you are aware that the other buyer got her replacement set.

Tell her that if you dont hear from her you will have no choice but to attempt to sell the incorrect set. She obviously goofed bigtime. Has she left you feedback yet? I'd give it a few more days after another email to her (perhaps mentioning how you'd hate to leave what you think is appropriate feedback at this point).

No she has not left me feedback, nor has she left feedback for the other buyer. The other buyer has not left her any feedback.

Spoke too soon, the other buyer has left feedback for seller on the very book set that I have that does not belong to me. Something smells fishy to me.

Feedback was left on 3-4-02. That was 11 days ago and it was all praise. I emailed the other buyer on 2-24-02, I let her know then that I had her books, she responded to my email that very day.
