A customer used Buy It Now to end an auction of mine late Wednesday night. Shortly after, he used PayPal to send payment.

Somehow, he ended up sending 2 duplicate payments.

So, he e-mails today (Thursday) and explains that he sent 2 payments and would like the 2nd refunded to his PayPal account.

"No problem", I think. Since it was almost closing time here, I decided to put it off until later.

Shortly after, my wacky buyer then sends this rambling e-mail:

"I Have used the "Buy it Now" option. I used this because you are suppose to take care of this right away, and you have NOT!!!! I do not like the fact that you have not responded to me especially after I have payed you [deleted] of which I want $[deleted] back onto my paypal account because it mastakenly sent the money twice. It seems like you have been getting positive feedback and I hope I won't have to change that. If you don't respond I will be forced to report you to ebay for fruad. I have done this before and I do know the procedure. Once AGAIN I need $[deleted] back because I only want one set of item, and I wanted this item here ASAP. I used the "Buy it Now" option so you could send it thursday, which made it possible for the lights to be here by Saturday(I work at the post office and it takes three days for a package from [deleted] to arrive at my post office and UPS usually takes less) but it doesnt seem like that is going to happen. Please take care of this as quickly as possible"

First, there is no chance in you-know-where that package would arrive by Saturday. My terms state items are usually delivered within 10 days. If you want next day shipping, pay for it.

Second, my PayPal account is currently restricted thanks to a customer who filed a chargeback 2 days after the auction ended. So, I am unable to send the money via Paypal. Besides, it is company policy to refund money via check anyway.

I guess what gets my proverbial goat is the tone of this guy. He just spews threat after threat.

Why is everyone so angry lately?

Well, I don't really have any advice for you. I can say however, that you have titled this thread correctly.

I think it would be against Federal Law to refund by check. If a person pays by Credit card you MUST refund to that Credit Card. Only banks are allowed to give cash or checks using credit cards and then the Credit Card Company charges a much higher interest rate. For a company or individual to refund by cash or check would circumvent Federal Banking Laws

It seems like you have been getting positive feedback and I hope I won't have to change that.

When this happens to me, I leave negative feedback immediately. I would probably also cancel the deal. I don't need anyone's business enough to stand for their threats.

I like Twinsoft's advice personally.

In regards to how the refund should be processed, Paypal is not a bank so I'm not sure
if you would be governed by Federal Banking Laws.

You have stated that your account is frozen anyway so what else can you do except send a check?

I'm sure the buyer would become psychotic if
you explained that he might have to wait awhile
for the refund because of your paypal account status. Afterall, look what he did after
he was "forced" to wait 24 hours for a reply.

Take Twinsoft's advice.

I hate in when buyers expect instant shipping
if they send instant payment (BIN, Paypal etc.).

Granted, a Paypal payment will often ship faster than if the buyer sends a PO, but
I don't feel that sending an instant payment gives the buyer a right to expect same day or next day shipment.

I try to send same day or next day if possible, but I always ship within three days of receiving payment.

I think everyone will agree that it is much easier for a buyer to send an instant payment than it is for the seller to ship.

I received a MO on Friday and the PO was closed after I got my mail. I didn't feel like going to the PO on Saturday because it closes at noon and I like to sleep late, eat brunch etc.

So, I thanked the buyer on Friday for the payment and told him the package would most likely go out on Monday. He sent a MO BTW.

"Second, my PayPal account is currently restricted thanks to a customer who filed a chargeback 2 days after the auction ended. So, I am unable to send the money via Paypal"

How many chargebacks have you had? Did damon from paypal not state that they would not in most cases freeze an account for just one chargeback?

I would refund both payments, then cancel the deal.

Why do you not take out all payment info on your auctions so no one can just send $$$ to your account.

The last thing you want is more $$ going into a frozen account which just gets more bidders mad when they do not get their stuff.

I have had the same sort of customer a few times. I can remain unemotional about the whole thing until they try to intimidate me with the feedback card.
You have to dig a little, but I'll tell you, ebay has some good stuff to quote to these
idiots. The first states in their feedback policies that feedback may not be used to THREATEN or COERCE ( there is more) and the second comes from a copy of a legal suit filed against someone who left someone else undeserved negative feedback. This person actually sued the other person! It states that they can be sued for defamation of character as it would damage your business reputation. It is really good, scary stuff (and all factual). I usually send a letter telling them that they are being unreasonable, they have ASSUMED too much, they need to calm down, explain that this is your business, unwarrented neg. feedback would hurt your business , with all of the ebay info in quotes, providing them with the location of the information, with the reminder that... feedback works both ways.

Refund both (send him email stating due to paypal account being frozen will take few days, even a bank doesnt refund in minuted, they take days too....)

cancel a deal and read INOT post,
dont leave feedback yet,
(in case he leaves you neg
you can give him one ,
or pay $15.00 for square trade removal if he/she does leave a neg, then neg him
after yours is removed)
and save all his emails so you can show eBay
that he was threatning you with a neg...

you already have a headache over this, dont make it a bigger one

you named the threah well,
so that should indicate that
the buyer is just not worth it...

good luck

ciao
Laiki
