You need to file a buyers complaint with paypal first. Would advice you to go to paypals website and read up on this. They give you the info you need there.

I once tried to get a PayPal refund from a website that had PP and never sent my items. I had to wait 30 days to file a report and after a few weeks PP wrote me and said the seller's account was empty and they could not recover any funds and they took away his account. A week after that the seller sent my stuff.

I will assume that you paid with your CC? If that is the case then deal with your bank that you have your CC thru.
They should be able to do a reverse for you.
You can also file a fraud report with ebay.

Go ahead and file a complaint with Ebay. Also, if you paid by credit card file a chargeback. If your credit card company will not honor the chargeback or you did not use a CC, Ebay will give you up to $200 with a $25 deductible (max $175) as long as they rule in your favor on the complaint and both you and the seller had feedback of 0 or higher at the time of the transaction. If the $175 + $25 deductible does not cover your payment, Paypal will give you up to another $200 once you get your check from Ebay and send them a copy of it.
If you do the chargeback through your CC, Paypal might close down your account but as long as you followed their TOS, you can get it re-opened. I emailed Damon and he got my acct reviewed and opened after I did a chargeback against a fraudulent seller.

As was noted in another thread that by the time PayPal is finished with their "investigation" the time-limit to do a chargeback with your Credit Card company is past and you are out of luck.

That is not true, Mlecher. I filed a complaint with Ebay and Paypal. They ruled in my favor but, of course, the seller had no money in his account. I then did the chargeback. With most credit cards, you have up to 60 days from the date that you receive the statement (and how can they prove the exact day you got it) to file a chargeback. That gives you plenty of time as long as you use it properly. Most credit cards will even take a chargeback after more time than that. After all, if they refuse the chargeback, you could refuse to pay them and then they would be out the money and a good customer. If they honor the chargeback, Paypal is out the money and your CC keeps their happy customer.

Maybe at times that is true. However, by the time you have waited for the items(oh, say 10-14 days), tried to contact the seller(oh, say 4-5 days), eBay(add 2-3 Days), then PayPal's "investigation"(which can take up to 45 days), your 60 days is up....
Skip one of those steps and PayPal takes your balance and restricts your account.

Mlecher, it is not 60 days from the time you paid but 60 days from the time of your statement. That could be up to 30 days from the date that you paid. They can't hold you responsible for a purchase from the date of the purchase because, if it is fraud, you don't know about it until you get your statement.
