The winning bidder hadn't paid. So 10 days after the auction ended I looked at her FB and saw 2 new negs for non-payment. I also looked at her bidding history, ver heavy and at one of the auctions she ran (she isn't a regular seller). Her TOS tells people to ignore all of her negs because they are undeserved and she "only negs sellers". I'm not afraid of a neg; I just want you to to get a feel for the character involved. I send her an e-mail giving her a deadline and also file the NPB alert. No point waiting.

The next day I hear from two of the sellers she's stiffed and negged. I told them to file for FVF as that was the only recourse. So I know she has two warnings. These sellers were really hot. One I walked through the process.

Naturally I get a payment within my deadline via priority mail. A slow payment is better than no sale so ignoring my gut that this was trouble, I invisibly marked the item and sent it on it's way. All the NPBs must have scared her.

You guessed it. A couple of days later I get an e-mail telling me there is an undisclosed flaw. What am I going to do about it. I said send it back and don't wash it because it's invisibly marked and no mark = no refund.

I got it back today. It's marked with my fingerprint BUT there is NO flaw. And I really, really looked. Buyers remorse!

Here's the thing. I want my fees back. If I file for FVF she's three strikes and out. She did pay and doesn't technically deserve to be booted. She is a buyer from he;; and I'm sure she's done this before and will continue to make seller's lives miserable.

Can I get my fees back no harm no foul??? How?

First of all, I believe the eBay rules & regs state 3 NPB's & then suspension. Not FVF's. There is a difference. You can file an FVF, in this case because the product was returned with agreement of the seller. No harm No foul.

If you have haven't already filed the NPB do so asap. You have 45 days from the day the auction closed. Choose the option "High bidder paid for item & returned it. Refunded payment"

Then file for the FVF.

Never ignore your gut feeling as you now know what your in for. I would not refund in this case. just tell them that there is no flaw and you will not refund for bidders remorse and if they want the item back to resend shipping costs.

Put the ball back in their court as you can file for your fees and this flake will be gone.
They are just looking for a way to keep from getting the boot so they are jerking you around.
The worst that can come from this is that you refund and file as this is a scam on their part.

Did she say what the flaw was?

If you want to just get out of this easy, filing for your fees under "paid for item and returned it" section. I don't believe it counts as a strike on her. I would, however, deduct the shipping charge from her refund.

My gut says chalk it up and move on. She has all the hallmarks of the buyer from hell. I can relist it and still make a profit.

I tried to file for the FVF but it didn't have a place for "mutually terminated transaction". I think it just assumes deadbeat. Is this an e-mail to Billing? Or is there an automated way that I'm missing?
