A German friend of mine bought $500 in merchandise from a guy in NY. The items never arrived and the seller refuses to talk to him. He paid with Pay Pal with a balance in his account. I told him to contact Pay Pal. Pay Pal told him since the seller has no funds available, he was pretty much out of luck. Does that sound right? Pay Pal should pay him back in my opinion.

Why should PayPal pay him "back?"

The PayPal Buyer Protection Program SPECIFICALLY states that funds MAY NOT ALWAYS BE RECOVERED in cases of fraud!

By signing-up with PayPal, your friend states that he understands and AGREES to PayPal terms of use.

Call the cops in the seller's hometown & raise a stink along with the FBI's internet fraud link -- it worked for ME

Did he pay paypal with a credit card? That's the better route to take to try to recover the money.

question-when paypal said there is no fund in seller account,what happens??
does paypal go ahead and debit his account with that 500 dollars??
if the seller ever receive payment in this account,it will net against the debit.
if he opens a new account and receive payment and paypal finds out the two accounts are related,it would lock up his new account.
this is how it works when buyer paid with cc fund and filed chargeback,but does it work the same way when buyer uses his own paypal fund and just complain to paypal??

your german friend should report to ebay and file for insurance.he will get 175 back

My German friend is the buyer. The seller is out of NY. The first thing I told him was to contact Pay Pal and his credit card company. Turns out he paid with a balance he already had in his Pay Pal account. Pay Pal told him the seller has no funds, and the seller did contact Pay Pal.

I once bought an item off the web at a website with my paypal account and existing funds. The item never showed and I contacted PP about a refund. I got the 'no funds in seller's account' message and that was the end of it as far as PP was concerned.

if so,then your german friend will collect 175 from ebay-200 minus 25 deductible,tell him to go to ebay site and follow the guidelines.
may be you can call the seller for him and talk to him,these days many people are desperate,this seller must not have the items on hand.
some buyer has found a way to determine if the seller does have the merchandise or he just have a photo by asking him to take photo of the mark or from a different view

I am going through a similar situation now. The first thing buyer should do is FILE a claim with PayPal now. PayPal will investigate and place a hold on the account, seeking funds from the account that supports PayPal account. What is not mentioned is whether the seller has shipped with delivery confirmation. If not, PayPal will attempt to recover funds for buyer.

THEN file a claim with eBay as required.

Quit fooling around with phone calls, etc. First things first.... File the online claim forms and then call.

If Ebay pays the claim, Paypal will give the buyer up to another $200 with proof of the Ebay payment. At least they used to do this. That is how I came out even on one where I had used my Paypal balance to pay a deadbeat seller.

read the thread,the buyer has already filed paypal complaint and heard from paypal-no fund in seller account!!

Now, I have just re-read all the postings. Nowhere is it stated that a claim was filed. Seller or writer do not indicate the filing of a claim.

Let's have the writer inform us whether a claim was filed. A phone call to a PayPal rep. is not filing a claim.

My friend did file a claim with Pay Pal and they told him the seller has no money to refund. The seller has not responded to Pay Pal or my friends phone calls. He paid with funds that were in his Pay Pal account so he can't file a claim with his credit card. Thank you for sharing your experiences with me. I will pass on the information.

paypal paid you the difference between your loss-ebay insurance,is that under buyer protection?/
this is a case -buyer is in germany while seller is in usa,how does the buyer protection work>>
i know seller gets no protection.

Something tells me we're only hearing 50% of the story. The rest of the story is probably something like......Buyer in Germany asks, " "Can you ship with no value". Seller says "ok but then no insurance". Buyer agrees. Then either the seller never shipped or it's lost in mail. Now the German buyer wants it both ways. Saving on customs can hurt you.

The way it worked for me: I filed a claim with Paypal and with Ebay. Both of them approved my claim. Paypal said "sorry, the guy defrauded you but he has no money in his account". Ebay has insurance. If both buyer and seller have positive feedback (>0) and either you can not chargeback with your credit card or did not use a credit card, you can file an insurance claim of up to $200 with a $25 deductible. When Ebay approves it and sends your check, you send a copy of the check to Paypal along with the information about your approved claim with them and they will give you up to an additional $200. Paypal would only do this on Ebay auctions.

As I said, I don't know if they still do this. You have to look through all of their fraud stuff. This was about 1.5 years ago but it saved my bacon when I used my Paypal balance to pay what turned out to be a fraud seller. The seller had 240+ feedback.

This guy's purchase was $500. He will still lose some money but $125 is better than $500.

I was lucky. I got enough back to cover what I had lost.

I told my friend to contact Ebay. The seller is NRU now. I hope he can get something back $. Thanks for your suggestions.

this is from paypal website,it looks like your german friend would not qualify for paypal supplemtal coverage-

Note: PayPal's supplemental eBay coverage only applies to domestic buyers who pay Verified sellers.
