I won an auction 6 days ago. I paid immediately with PayPal and the payment is "completed"
The seller has not acknowledged my wining bid. I have emailed 3 times now, asking for confirmation of wining bid and payment received and when I can expect my item.
There has been no response at all! I just tried calling and a child answered the phone, said seller ( can't use names here) was not there and did not know when they would be there.
Why would a seller with a feedback of 675- 97% positive, do this, and what do I do next?

it is not unusual for dealers to go out of town on buying trip.
if you have paid with paypal,seller is asked to ship promptly,defined by paypal as no later than 7 days after payment received.
it is up to you when you want to file for buyer complaint,you may do so within 30 days to get a full refund.

This may be a seller that is over automated. They may have just processed the payment and shipped and their customer service is leaving something to be desired.

You have gone beyond what you are supposed to do. Ebay's policy for sellers is that they need to contact the buyer within 3 business days. Did you receive an email from the seller at all? Have you sent more than one email to the seller asking for confirmation of your payment and shipping info as to when they will be shipping the merchandise? If so, did you keep a copy of the sent emails? Email them again and ask for a reply to the shipping details email within 7 days or you will need to take further action.

Even if a seller is using automatic replies, they still should read their emails and reply to them within a week's time. (I think this is more than fair to the seller) If they don't respond. Take action. I wouldnt try to call their house again.

I had this happen to me. Paypal requires shipment within 7 days of payment. If you don't get it really soon you can file a complaint with PP. The seller then has 10 days to respond or PP refunds your payment or whatever amount he has in his account if the full amount isn't there. I'm not sure if there's a waiting period before you can file. I filed at 12 days.

No, I have not received any communication from the seller. Not even a WBN. Yes, I have emailed the seller 4 times now, each time requesting they acknowledge that I won the auction, that I had paid and when they were going to ship. Have not gotten one response...it's as if the auction never took place.
I have kept all copies of the emails. The seller is starting to get neg's from other buyer's since my auction ended.
I want to give the seller the benifit of doubt, since things do happen. ( I was admitted to the hospital for 9 days in the middle of my auctions one time. Lucky me, my husband who knows nothing about computers, email or eBay braved his way into notifying the winning bidders and sending their items)
I just can't understand why I have not received any communication at all...

i would file complaint with paypal.if others have negged him/her,they could have already filed complaint if they have used paypal/
those who file first get the spoil first,if there is any left in his paypal account

Here's another thought...can you cancel your payment? Unless this is a one of a kind super bargain that's probably the safest route and the least hassle.

I'm not worried about getting my money back. I paid with a credit card ( I always do if the purchase is over $10.00-got stung once before)
Just wanted input on what a resonable time would be before taking action...darn, I really wanted the item!

those who file first.

Here's the response I got from PP today..

"Our investigation has determined that the seller is at fault, but we were unable to recover any funds from the seller's account. As stated in the PayPal User Agreement,Buyer Complaint funds recovery cannot be guaranteed.

If this transaction took place on an auction site, we encourage you to contact the auction site and see if they offer insurance coverage.

We appreciate your business, and regret this experience."

Contact the auction site? Doesn't Ebay OWN PP?

That's the same message I got when I got stung the first time. But, it was only for $15.00 and eBay wanted $25.00 to process the claim.
That is why I started using the charge card...the bank will take care of it for me, if I go the item never received route-if I can't get PayPal to do a charge back.

I am still hoping the item just arrives in the mail (wishful thinking maybe)

You did what was required and tried to retrieve your funds through PayPal.

Now it is time to contact your credit card company and initiate a chargeback.

Make sure you have no funds sitting in your PayPal account before proceeding. Also, if you have a bank account attached to the PP account, go to the bank and put a block on PP from pulling funds from your account.

They will probably get annoyed and lock your PP account.

I have a seperate checking account just for PayPal, but can they really take money out without authorization?

depends on when you sign up for paypal,after nov of last years???????someone please confirm this,you have agreed to allow paypal access your bank account.
ebay does not charge 25 for insurance claim,that 25 dollars is the deductible .so if your loss is 25 or less,you get nothing back.

I guess I better go read my Paypal agreement. I joined PayPal in 1999. from what you are saying, i better wait until all my auctions are over before i take any action.
What do they do if you don't have any money in your bank account?

Here is the PayPal policy on charge backs:

PayPal encourages all buyer purchase disputes to be filed and resolved through the PayPal dispute resolution process. PayPal reserves the right to terminate or limit account access privileges of buyers in any of the following cases: abuse by a buyer of the reversal process provided by the buyer's issuing bank; filing a chargeback against an unauthorized transaction; consistent failure to pursue PayPal's Buyer Complaint Process before pursuing any alternate reversal process provided by the buyer's issuing bank. If a reversal claim is initiated, whether as a result of a dispute or for any other reason, the parties agree to provide to any requesting party on a timely basis any and all necessary documentation to resolve any reversal or dispute. PayPal DOES NOT act as the agent of either party in any transaction or resulting dispute, though PayPal does control the outcome of disputes initiated through the Service's dispute resolution process.

If I am reading this correctly, as long as the claim is legit, you go through PayPal first and you are not abusing the system there should be no problem......am I crazy if I trust the system?

You're crazy if you trust the system.

PP has restricted accounts before for initiating a chargeback via the CC company.

PP is the one who gets slammed with a fee for the chargeback by the CC company, not the seller, so PP gets their back up when a user takes the chargeback route.

Here's the thing with a CC chargeback. Your bank will not process one until 30 days has elapsed. Under both VISA and MasterCard rules the merchant has 30 days to deliver. But right now it looks like a chargeback is your only option.

I don't think PP will penalize you since this guy has gone into default and it's not like you're doing chargebacks by the dozen.

I have been buying on ebay since '99 and not once have I requested a refund or done a chargeback, even though at times I wished I had.
It has only been a week since the auction ended and I have my fingers crossed. I did send another email to the seller (who by the way has two pages of auctions running while we speak) and let them know if I don't get some kind of response by Saturday I am going to have to take action.
I will go through all the PayPal requirements, and make a complaint to eBay if it goes that far.
Just for the heck of it (and I would like input from other sellers) if by some chance my item does show up in the mail-what type of feedback does one leave for something like this? Out of over 200 transactions I have only left a neg by mistake and spent the $20.00 to get it removed (seller did nothing wrong-I checked the wrong box)

Finaly heard from the seller! I again emailed-this time I used "ask the seller a question" from a current auction for the same thing I purchased!
Seller got back to me wanting to know what method I used to pay for the item and then went on to say they would look into it.
Some service...I have a feeling I am going to be told they can not ship and refund my money. I feel this way because my wining bid was lower than the average bid for this item.........sure hope I am wrong!
Since they do have an identical item up for auction now I don't see any excuse not to receive the goods.
would have been nice to receive at least an explantion!

Well, here is the final results: After getting an email from seller wanting to know what method I used to pay, I again heard nothing.
After 4 more emails to the seller,including one where I let them know I thought they were not going to deliver and I did know that they had sold 7 more of the same item in the last week, I get an email saying the package had been shipped on June 16th-3 days after auction ended ( why didn't they let me know this before> Why didn't I get a WBN? Your guess is as good as mine!)

Package arrived today! There was no date stamp on it so I have no idea when it was really mailed. If it was mailed on the 16th it took 8 days to go 3 states by Parcel Post.

All of this could have been avoided if only the seller had bothered to make contact with me after the auction ended. I have to say this is the worst transaction I have had in the 5 years I have been buying on eBay!

I often buy things on ebay and get zero correspondence from them. Many times the seller is only selling a few items. At a minimum they need to send a WBN and an email letting them know when the item is sent. Too many ebay sellers are totally losing the personal touch in their ebay selling.

I think you're being maybe a little hard here on the seller. You won the auction on 6/13, you've received your item 6/24 (shipped parcel post), which is certainly a reasonable length of time. Many ISPs are blocking whole domains because of the spam problem--that could be why you didn't get a response from the seller until you went through "ask the seller a question" on eBay. Things happen, stuff gets lost in the shuffle. Maybe this isn't a very "hands-on" kind of seller. But I don't think she deserves a neutral or neg. You got your item in a reasonable time, and apparently you have no complaints about the item itself. Leave a positive and move on.

I have to say this is the worst transaction I have had in the 5 years I have been buying on eBay!

If that's the worst, then you should consider yourself extraordinarily fortunate.

After all, you did get what you bid on, in a reasonable timeframe, and presumably it was as represented.

The seller's biggest sin is not being a mindreader to divine what your expectations were.

Some sellers (I am one of them) receive so damn much mail there is absolutely no way they can respond to all of it on a timely basis. Blame your fellow bidders, many of whom cannot be bothered to actually read the auction text or figure out how to retract their "mistaken" bid. I got 50 emails this last week ALONE from people demanding that I retract their bid for them because they screwed up. (Of course by the time I got the mail it was way too late.)

And why does a PayPal'er need a confirmation of payment received? That's just nuts! You HAVE a transaction record. You HAVE a transaction ID. As long as you spell the PayPal address correctly, the seller got your money.

I never send payment confirmations.

I don't think I am being hard on the seller. I paid immediately when the auction ended. I waited 4 days to hear from the seller and not one word of acknowledgement that I had the winning bid or when the item was going to be shipped.
After seven days had passed and I had sent several emails the only thing I got from the seller was an email on the 7th day wanting to know what method I used to pay., no mention that it had been shipped. As mentioned, can't they look at their own account and see it was paid at auction end and how?
This seller has sold several hundred items and has had 10 negs in the last month for the same thing.
My first 4 emails were gentle-just asking for confirmation of payment and when they would be shipping, not "Why isn't it here yet?" eBay's own rules state communication must be made within 3 days. If seller had contacted me I would have been satisfied.
As for my expections......as a buyer I do expect some communication. If this seller had simple sent an email stating that the item had been shipped I would have been happy. Instead it took me 11 days, 9 emails and 2 phone calls to get this information. Up to that point I had no idea if it had been shipped, or if they even knew that I was the wining bidder.
I have been a buyer and seller for 5 years and to me this is unacceptable.
On my last purchase I knew it would be around 14 days before I should look for the item in the mail and that was fine. The key word here is "I knew"
With all the cooked deals on eBay, any buyer is going to get jumpy if they don't here from the sellerfor that amount of time.

I did want to mention that 3 months ago I purchased an item, paid immediately. Waited calmly, after 3 weeks when item didn't arrive I started taking steps-guess what-seller is suspeneded from eBay, their PayPal account has been closed and their phone has been disconnected and they had made 200 sales-I wasn't going to take the chance of that happening again.
Especially for $41.00.

Then you'd best make your standards clear to every seller you buy from.

I had one like you just the other day. "You didn''t send me a payment confirmation! You didn't send me a shipment confirmation!"

I said, "Lady, I'd have to pay someone five times the $1.25 you paid for this item to send those emails. Ain't gonna happen."

If a couple of weeks had gone by and you hadn't received your item or any communication from the seller, I think you would be well within your rights to file a complaint and a neg--BUT you received your item in 11 days. And don't go on about how many emails you had to send to get it shipped--you don't know when it was shipped, and you don't know if your seller even received all of your "polite" pesty emails. So what if you didn't get all the hand-holding you thought you needed. You've got your item in your hot little hands in a reasonable amount of time and you're not dissatisfied with it (or at least you haven't said that you are). Your seller fulfilled her part of the bargain.
