On Nov. 1, 2003,I won two auctions from the same seller. The items were identical and I needed two.
The seller sent an automated paypal e-mail combining the two wins into one payment. I paid through Paypal.
After one week, I began to e-mail the seller asking if the items had shipped yet. No response- two days later I e-mail again.
Well Saturday, I receive an e-mail stating that the seller only had one item and I could cancel the sale. I e-mailed immediately and asked for a refund.
I still have had no response from the seller and no refund. I realize it has just been 2 days since her e-mail but this seller sells hundreds of items at one time so I know she must be on the computer alot.
Is there anything I can do at this point? ( Other than wait even longer)
This seller waited two weeks to tell me she did not have the item.

They should have given you an immediate refund. Since they did not, file for non-delivery of items with PayPal RIGHT NOW. Do not wait for a response. The seller should know that you would be repsonding and be looking for it, even it the are super busy.

File against seller for not having item available with Ebay too.
Sellers are supposed to have items on hand, unless they clearly state that in the auction. Ex: Drop shipment

Late last night, I decided to file a complaint with paypal.
Well, I just checked my e-mail and the seller refunded the money.
Thanks for all the advice. If I had not have filed the complaint, I do not know when she would have refunded my money.
If she takes two weeks to tell she made a mistake and does not have the item, she sure would not have been in a hurry to refund my money.
I am SO frustrated with sellers lately! This is just one of about five transactions I have had lately where the seller did not do what he/she should. For example, not shipping when promised and items not as described.
