A seller in Germany stole my picture and used it in his auction.{ebay Germany}Needless to say, it was not linked, then I could have had some fun.
I put my name on the pictures, and he even left it on the picture.
The auction ended Sunday
I turned him in to ebay, and this is the response....Jst recd it now....
BIG DEAL !!!!
[i]Dear eBay-Member,
thank you for you mail.
We are very sorry to hear that you've been having problems with another
eBay-member.
We hope you understand that we have not yet ended the listing you have
reported. Unfortunately we have no means to verify whether it is an
infringing violation. Thus we are limited in our possibilities to help
solve such dissensions.
Please also take note of the fact that every member bears responsibility
for their listings.
Unfortunately by German law we are not able to give you legal advice
either. We recommend that you clarify the situation with the member
yourself.
Additionally it would also be helpful if you informed the member who
used your graphical material yourself first. Often this motivates the
member to end his listing or to take out the graphical material.
In regard to your mail to inform us that eBay-member xxxxxxx has used
your graphical material in his listings and thereby violated your
rights, we have contacted xxxxxx to inform him of your contact details
and asked him to get in touch with you.
We hope we were able to help you. Should you have any further questions,
please do not hesitate to contact us.
Kind regards,

I did email the seller and asked them to remove my picture.
Reply was, it's not your picture, I bought the item from a different seller, and this is the picture he used.
I checked, it was not the same picture.

I certainly understand your irritation, and more.
But, unfortunatley, the eBay response is typical. In so many words, they just don't care.
Until a rival pushes eBay, I'm afraid we are in for much of the same. However, I think a viable alternative will surface. The business market is just too large for eBay to control, as more or less a monopoly.

An ebayer on the Germany site, emailed me to let me know.
He must have looked on the ebay USA site, and found my auction with the same picture and emailed to tell me.
Was very nice of them, and I replied with free shipping to them if they bought a item like it from me.
Free shipping to Germany.. Yes..Would cost me around $3-4 or so..
I don't look at to many of the other non USA ebay sites... but it got me to thinking ?????

The international ebay's are a different kettle of fish that the main one. A bit more chickencrapish than the mother ship.
